  1                      A bill to be entitled

  2         An act relating to Monroe County; creating the

  3         Key Largo Wastewater Treatment District, an

  4         independent special district; creating a

  5         district charter; specifying the boundaries of

  6         the district, consisting of certain land areas

  7         transferred from the Florida Keys Aqueduct

  8         Authority; providing powers and duties of the

  9         district; providing for a governing board;

10         providing for membership, qualifications,

11         terms, powers, duties, and compensation of the

12         board; amending chapter 76-441, Laws of

13         Florida, as amended; terminating jurisdiction

14         of the Florida Keys Aqueduct Authority over all

15         lands transferred to the district; providing an

16         effective date.

18  Be It Enacted by the Legislature of the State of Florida:

19

20         Section 1.  The Key Largo Wastewater Treatment District

21  and its charter are created to read:

22         Section 1.  Creation; boundaries; jurisdiction.--There

23  is hereby created an independent special district to be known

24  as the Key Largo Wastewater Treatment District. The district

25  is organized to construct and operate facilities for the

26  collection and treatment of wastewater. The district shall

27  consist of Key Largo, including all lands east of Tavernier

28  Creek, including Tavernier, Key Largo, and Cross Key, with the

29  exception of Ocean Reef, all in Monroe County, Florida. The

30  district shall have jurisdiction over the collection and

31  treatment of wastewater within the district boundaries.

  1  Jurisdiction of the Florida Keys Aqueduct Authority over

  2  wastewater collection and treatment within the district is

  3  hereby terminated.

  4         Section 2.  Powers and duties.--The district shall have

  5  all the powers that may be exercised by the Florida Keys

  6  Aqueduct Authority pursuant to chapter 76-441, Laws of

  7  Florida, as amended, for the collection and treatment of

  8  wastewater.

  9         Section 3.  Governing board; membership; powers and

10  duties.--

11         (1)  In accordance with the provisions of chapter 189,

12  Florida Statutes, the governing board of the district shall

13  consist of five elected members, who must be residents and

14  electors of the district. Governing board members shall be

15  elected at large in a nonpartisan election held in conjunction

16  with each general election. Any individual desiring to be

17  elected to the governing board must qualify pursuant to

18  general law. The candidates receiving the highest five vote

19  totals shall be deemed elected to the governing board. The

20  terms of office shall be 4 years and shall begin and end on

21  the same dates as do the terms of the members of the Monroe

22  County Commission; however, at the initial election, the

23  governing board members elected with the two lowest vote

24  totals shall each serve a term of only 2 years. Thereafter,

25  all governing board member terms shall be for 4 years. The

26  governing board shall adopt all rules necessary for the

27  conduct of its business. Governing board members shall receive

28  as compensation for their services a fee of $300 per meeting,

29  not to exceed three meetings per month. The amount of

30  compensation shall be adjusted annually based upon the index

31  provided in section 287.017(2), Florida Statutes. In addition,

  1  each board member shall be reimbursed for expenses as provided

  2  in section 112.061, Florida Statutes. Governing board members

  3  shall be bound by the conflict of interest and disclosure laws

  4  applicable to public officers as set forth in part III of

  5  chapter 112, Florida Statutes.

  6         (2)  At the first meeting of the governing board, the

  7  governing board members shall elect one of their members to be

  8  the chair of the board. Thereafter, the chair shall be so

  9  elected on an annual basis.

10         Section 2.  The area described in section 1 of the

11  charter created by this act is removed and deleted from within

12  the boundary lines of the Florida Keys Aqueduct Authority as

13  re-created by chapter 76-441, Laws of Florida, as amended.

14         Section 3.  This act shall take effect upon becoming a

15  law.
