1 A bill to be entitled
2 An act relating to campaign finance; creating
3 s. 106.115, F.S.; requiring persons to maintain
4 records and to file disclosure of certain
5 political expenditures in which a candidate is
6 named or depicted; providing penalties;
7 providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 106.115, Florida Statutes, is
12 created to read:
13 106.115 Certain disclosures required.--
14 (1) Each person that makes an expenditure during the
15 60 days before any election for the purchase of a political
16 advertisement that names or depicts a candidate for office in
17 that election, whether in print or in a broadcast medium, must
18 disclose the source of the funds expended, the amount
19 expended, and the recipient of the funds. If the person is a
20 candidate or political committee required to appoint a
21 campaign treasurer, the campaign treasurer is responsible for
22 maintaining the records necessary to comply with this section
23 and for filing the disclosure. If the person is a natural
24 person who is not a candidate, he or she is responsible for
25 maintaining the records necessary to comply with this section
26 and for filing the disclosure. If the person is any
27 organization other than a political committee, it must
28 designate an individual responsible for maintaining the
29 records necessary to comply with this section and for filing
30 the disclosure. Disclosure under this section must be filed at

1 least 10 days before the election with the officer before whom
2 the candidate named or depicted is required by law to qualify.
3 (2) Failure to file a disclosure required by this
4 section is subject to the same penalties as failure to file a
5 report required by s. 106.07.
6 Section 2. This act shall take effect January 1, 2003.

9 SENATE SUMMARY
10 Requires that a person sponsoring a printed or broadcast
political advertisement that names or depicts a candidate
11 for office within 60 days before the election must report
the source, amount, and recipient of the funds. The
12 disclosure must be made at least 10 days before the
election with the officer before whom the person depicted
13 has qualified. Failure to make the required disclosures
is punishable by fine.
