11  The Committee on State Administration offered the following:

13         Amendment 

14         On page 1, line 16 through page 2, line 12,

15  remove:  all of said lines

16

17  and insert:  (1)  Any condition or impairment of health of any

18  Florida state, municipal, county, port authority, special tax

19  district, or fire control district firefighter or any state

20  law enforcement officer, correctional officer, or correctional

21  probation officer as defined in s. 943.10(1), (2), or (3),

22  respectively, caused by tuberculosis, heart disease, or

23  hypertension resulting in total or partial disability or death

24  shall be presumed to have been accidental and to have been

25  suffered in the line of duty unless the contrary be shown by

26  competent evidence. However, any such firefighter or state law

27  enforcement officer shall have successfully passed a physical

28  examination upon entering into any such service as a

29  firefighter or state law enforcement officer, correctional

30  officer, or correctional probation officer, which examination

31  failed to reveal any evidence of any such condition.  Such

  1  presumption shall not apply to benefits payable under or

  2  granted in a policy of life insurance or disability insurance,

  3  unless the insurer and insured have negotiated for such

  4  additional benefits to be included in the policy contract.

  5         (2)  This section shall be construed to authorize the

  6  above governmental entities to negotiate policy contracts for

  7  life and disability insurance to include accidental death

  8  benefits or double indemnity coverage which shall include the

  9  presumption that any condition or impairment of health of any

10  firefighter, law enforcement officer, correctional officer, or

11  correctional probation officer caused by tuberculosis, heart

12  disease, or hypertension resulting in total or partial

13  disability or death was accidental and suffered in the line of

14  duty, unless the contrary be shown by competent evidence.
