13         Amendment to Amendment (121137) (with title amendment) 

14         On page 105, between lines 24 & 25,

16  insert:

17         Section 101.  Section 765.539, Florida Statutes, is

18  created to read:

19         765.539  Organizations engaged in the practice of

20  cadaveric organ and tissue procurement or processing; pooling

21  of cells or tissues prohibited.-Organizations engaged in the

22  practice of cadaveric or surgical organ and tissue procurement

23  or processing in this state are prohibited from allowing human

24  tissues from two or more donors to be pooled during retrieval,

25  processing, preservation, or storage unless said tissue is

26  sterile and free of all infectious agents, as determined by

27  the Agency for Health Care Administration, based on input from

28  the Organ and Tissue Procurement and Transplantation Advisory

29  Board.  This includes unconventional infectious agents, such

30  as prions, which cause Transmissible Spongiform

31  Encephalopathy.  For purposes of this section, "pooled" means

  2  allows any fluids or tissues to be commingled in any way
