13         Amendment (with title amendment) 

14         On page 8, between lines 13 & 14,

16  insert:

17         Section 5.  Section 401.23, Florida Statutes, is

18  amended to read:

19         401.23  Definitions.--As used in this part, the term:

20         (1)  "Advanced life support" means the use of skills

21  and techniques described in the most recent U.S. DOT National

22  Standard Paramedic Curriculum by a paramedic under the

23  supervision of a licensee's medical director as required by

24  rules of the department. The term "advanced life support" also

25  includes other techniques which have been approved and are

26  performed under conditions specified by rules of the

27  department. The term "advanced life support" also includes

28  provision of care by a paramedic under the supervision of a

29  licensee's medical director to one experiencing an emergency

30  medical condition as defined herein.

31         (1)  "Advanced life support" means treatment of

  1  life-threatening medical emergencies through the use of

  2  techniques such as endotracheal intubation, the administration

  3  of drugs or intravenous fluids, telemetry, cardiac monitoring,

  4  and cardiac defibrillation by a qualified person, pursuant to

  5  rules of the department.

  6         (2)  "Advanced life support service" means any

  7  emergency medical transport or nontransport service which uses

  8  advanced life support techniques.

  9         (3)  "Air ambulance" means any fixed-wing or

10  rotary-wing aircraft used for, or intended to be used for, air

11  transportation of sick or injured persons requiring or likely

12  to require medical attention during transport.

13         (4)  "Air ambulance service" means any publicly or

14  privately owned service, licensed in accordance with the

15  provisions of this part, which operates air ambulances to

16  transport persons requiring or likely to require medical

17  attention during transport.

18         (5)  "Ambulance" or "emergency medical services

19  vehicle" means any privately or publicly owned land or water

20  vehicle that is designed, constructed, reconstructed,

21  maintained, equipped, or operated for, and is used for, or

22  intended to be used for, land or water transportation of sick

23  or injured persons requiring or likely to require medical

24  attention during transport.

25         (6)  "Ambulance driver" means any person who meets the

26  requirements of s. 401.281.

27         (7)  "Basic life support" means the use of skills and

28  techniques described in the most recent U.S. DOT National

29  Standard EMT-Basic Curriculum by an emergency medical

30  technician or paramedic under the supervision of a licensee's

31  medical director as required by rules of the department. The

  1  term "basic life support" also includes other techniques which

  2  have been approved and are performed under conditions

  3  specified by rules of the department. The term "basic life

  4  support" also includes provision of care by a paramedic or

  5  emergency medical technician under the supervision of a

  6  licensee's medical director to one experiencing an emergency

  7  medical condition as defined herein.

  8         (7)  "Basic life support" means treatment of medical

  9  emergencies by a qualified person through the use of

10  techniques such as patient assessment, cardiopulmonary

11  resuscitation (CPR), splinting, obstetrical assistance,

12  bandaging, administration of oxygen, application of medical

13  antishock trousers, administration of a subcutaneous injection

14  using a premeasured autoinjector of epinephrine to a person

15  suffering an anaphylactic reaction, and other techniques

16  described in the Emergency Medical Technician Basic Training

17  Course Curriculum of the United States Department of

18  Transportation.  The term "basic life support" also includes

19  other techniques which have been approved and are performed

20  under conditions specified by rules of the department.

21         (8)  "Basic life support service" means any emergency

22  medical service which uses only basic life support techniques.

23         (9)  "Certification" means any authorization issued

24  pursuant to this part to a person to act as an emergency

25  medical technician or a paramedic.

26         (10)  "Department" means the Department of Health.

27         (11)  "Emergency medical condition" means:

28         (a)  A medical condition manifesting itself by acute

29  symptoms of sufficient severity, which may include severe

30  pain, psychiatric disturbances, symptoms of substance abuse,

31  or other acute symptoms, such that the absence of immediate

  1  medical attention could reasonably be expected to result in

  2  any of the following:

  3         1.  Serious jeopardy to patient health, including a

  4  pregnant woman or fetus.

  5         2.  Serious impairment to bodily functions.

  6         3.  Serious dysfunction of any bodily organ or part.

  7         (b)  With respect to a pregnant woman, that there is

  8  evidence of the onset and persistence of uterine contractions

  9  or rupture of the membranes.

10         (c)  With respect to a person exhibiting acute

11  psychiatric disturbance or substance abuse, that the absence

12  of immediate medical attention could reasonably be expected to

13  result in:

14         1.  Serious jeopardy to the health of a patient; or

15         2.  Serious jeopardy to the health of others.

16         (12)(11)  "Emergency medical technician" means a person

17  who is certified by the department to perform basic life

18  support pursuant to this part.

19         (13)(12)  "Interfacility transfer" means the

20  transportation by ambulance of a patient between two

21  facilities licensed under chapter 393, chapter 395, or chapter

22  400, pursuant to this part.

23         (14)(13)  "Licensee" means any basic life support

24  service, advanced life support service, or air ambulance

25  service licensed pursuant to this part.

26         (15)(14)  "Medical direction" means direct supervision

27  by a physician through two-way voice communication or, when

28  such voice communication is unavailable, through established

29  standing orders, pursuant to rules of the department.

30         (16)(15)  "Medical director" means a physician who is

31  employed or contracted by a licensee and who provides medical

  1  supervision, including appropriate quality assurance but not

  2  including administrative and managerial functions, for daily

  3  operations and training pursuant to this part.

  4         (17)(16)  "Mutual aid agreement" means a written

  5  agreement between two or more entities whereby the signing

  6  parties agree to lend aid to one another under conditions

  7  specified in the agreement and as sanctioned by the governing

  8  body of each affected county.

  9         (18)(17)  "Paramedic" means a person who is certified

10  by the department to perform basic and advanced life support

11  pursuant to this part.

12         (19)(18)  "Permit" means any authorization issued

13  pursuant to this part for a vehicle to be operated as a basic

14  life support or advanced life support transport vehicle or an

15  advanced life support nontransport vehicle providing basic or

16  advanced life support.

17         (20)(19)  "Physician" means a practitioner who is

18  licensed under the provisions of chapter 458 or chapter 459.

19  For the purpose of providing "medical direction" as defined in

20  subsection (14) for the treatment of patients immediately

21  prior to or during transportation to a United States

22  Department of Veterans Affairs medical facility, "physician"

23  also means a practitioner employed by the United States

24  Department of Veterans Affairs.

25         (21)(20)  "Registered nurse" means a practitioner who

26  is licensed to practice professional nursing pursuant to part

27  I of chapter 464.

28         (22)(21)  "Secretary" means the Secretary of Health.

29         (23)(22)  "Service location" means any permanent

30  location in or from which a licensee solicits, accepts, or

31  conducts business under this part.
