13         Amendment to Amendment (121137) (with title amendment) 

14         On page 61, between lines 1 and 2, of the amendment

16  insert:

17         Section 65.  Subsection (4) of section 468.80, Florida

18  Statutes, is amended to read:

19         468.80  Definitions.--As used in this act, the term:

20         (4)  "Orthosis" means a medical device used to provide

21  support, correction, or alleviation of neuromuscular or

22  musculoskeletal dysfunction, disease, injury, or deformity,

23  but does not include the following assistive technology

24  devices:  upper extremity adaptive equipment used to

25  facilitate the activities of daily living, including

26  specialized utensils, combs, and brushes; finger splints; a

27  device to treat injuries to the musculoskeletal system made of

28  either plaster of paris bandage or roll fiberglass bandage and

29  fabricated directly on the patient; wheelchair seating and

30  equipment that is an integral part of the wheelchair and not

31  worn by the patient; elastic abdominal supports that do not

  1  have metal or plastic reinforcing stays; arch supports;

  2  nontherapeutic accommodative inlays and nontherapeutic

  3  accommodative footwear, regardless of method of manufacture;

  4  unmodified, over-the-counter shoes; prefabricated foot care

  5  products; durable medical equipment such as canes, crutches,

  6  or walkers; dental appliances; or devices implanted into the

  7  body by a physician. For purposes of this subsection,

  8  "accommodative" means designed with the primary goal of

  9  conforming to the individual's anatomy and "inlay" means any

10  removable material upon which the foot directly rests inside

11  the shoe and which may be an integral design component of the

12  shoe.
