  1                      A bill to be entitled

  2         An act relating to state reserves; creating s.

  3         258.166, F.S.; establishing the Rodman

  4         Reservoir State Reserve; directing the Division

  5         of Recreation and Parks of the Department of

  6         Environmental Protection to develop

  7         multipurpose recreational opportunities and

  8         provide supervision of the area; allowing

  9         public hunting; authorizing the Division of

10         State Lands to acquire adjacent or contiguous

11         property; requiring the Division of State Lands

12         to notify persons with easements in the area;

13         requiring a report; providing an effective

14         date.

16  Be It Enacted by the Legislature of the State of Florida:

17

18         Section 1.  Section 258.166, Florida Statutes, is

19  created to read:

20         258.166  Rodman Reservoir State Reserve

21  designated.--There is designated and established a state

22  reserve to be known as Rodman Reservoir State Reserve, in

23  Marion and Putnam Counties, which shall include all

24  state-owned lands within the floodplain of the Oklawaha River

25  and those hereafter acquired by the state from Eureka Dam in

26  Marion County to Buckman Lock in Putnam County. Those lands

27  are deemed and held to be a state reserve, under the

28  supervision of the Division of Recreation and Parks of the

29  Department of Environmental Protection. The division is

30  charged with the duty of providing for the development of

31  multipurpose recreational opportunities at this reserve and

  1  the care, upkeep, maintenance, and beautification of the

  2  Rodman Reservoir State Reserve including all those dams,

  3  locks, and other structures transferred by the Federal

  4  Government to the state. Any action that would substantially

  5  alter the reserve as it existed on January 1, 2002, must be

  6  approved by law.

  7         (1)  Public hunting is allowed in the state reserve as

  8  authorized by the Fish and Wildlife Conservation Commission.

  9         (2)  The Division of State Lands of the Department of

10  Environmental Protection may acquire in the name of the Board

11  of Trustees of the Internal Improvement Trust Fund any

12  additional property adjacent or contiguous to the Rodman

13  Reservoir State Reserve, from private owners or from the

14  United States Government for improved management and

15  recreational opportunities.

16         (3)  The Division of State Lands shall identify,

17  contact, and inform all property owners who entered into

18  easements located within the taking line of the Rodman

19  Reservoir of the designation of this area as a state reserve.

20         (4)  By January 1, 2003, the Division of State Lands

21  shall submit a report to the Executive Office of the Governor,

22  the President of the Senate, and the Speaker of the House of

23  Representatives which:

24         (a)  Identifies the entities that have an easement

25  within the taking line of the reservoir.

26         (b)  Indicates whether the holder of the easement is

27  willing to sell the easement.

28         (c)  Estimates the cost of acquiring the easements.

29         (d)  Identifies any additional issues resulting from

30  this designation.

  1         Section 2.  This act shall take effect upon becoming a

  2  law.

      Designates an area in the floodplain of the Oklawaha
  7    River in Marion and Putnam Counties as the Rodman
      Reservoir State Reserve under the supervision of the
  8    Department of Environmental Protection. Allows public
      hunting in the reserve. Authorizes the acquisition of
  9    additional land and requires the notification of persons
      with easements in the reserve. Requires a report to the
10    Governor and the Legislature.
