  1                      A bill to be entitled

  2         An act relating to counties and municipalities;

  3         creating s. 775.0847, F.S.; providing enhanced

  4         penalties for repeat violations of county or

  5         municipal ordinances; providing definitions;

  6         providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Section 775.0847, Florida Statutes, is

11  created to read:

12         775.0847  Repeat violations of county or municipal

13  ordinances; definitions; enhanced penalties.--

14         (1)  For the purpose of this section:

15         (a)  "County or municipal ordinance" means any county

16  or municipal ordinance for which a term of incarceration may

17  be imposed upon conviction for a violation thereof.

18         (b)  "Conviction" means a determination of guilt which

19  is the result of a trial or the entry of a plea of guilty or

20  nolo contendere, regardless of whether or not adjudication is

21  withheld.

22         (2)  A person who violates a county or municipal

23  ordinance and who has five or more previous convictions for a

24  violation of a county or municipal ordinance within the 12

25  months immediately preceding the current offense commits a

26  misdemeanor of the second degree, punishable as provided in s.

27  775.082 or s. 775.083.

28         (3)  A person who violates a county or municipal

29  ordinance and who has 19 or more previous convictions for a

30  violation of a county or municipal ordinance commits a

  1  misdemeanor of the first degree, punishable as provided in s.

  2  775.082 or s. 775.083.

  3         Section 2.  This act shall take effect upon becoming a

  4  law.
