1 A bill to be entitled
2 An act relating to recreational activities at
3 facilities for elderly or disabled adults;
4 authorizing bingo games for residents or
5 clients of certain facilities for the elderly
6 or disabled, and their guests; providing
7 conditions; providing for use of proceeds;
8 providing exemption from local regulation and
9 fees; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Notwithstanding the provisions of section
14 849.0931, Florida Statutes, bingo games for residents or
15 clients of a facility licensed or authorized under part II,
16 part III, part V, or part XI of chapter 400, Florida Statutes,
17 chapter 651, Florida Statutes, or section 430.206, Florida
18 Statutes, and their guests, or for residents of
19 government-financed or government-insured housing for the
20 elderly and their guests, may be conducted if such games are
21 held in the facility, played exclusively by residents or
22 clients and their guests, and conducted by residents, staff,
23 or volunteers of the facility, and if neither the facility nor
24 any third party derives financial benefit from such games.
25 Nonresidents are prohibited from claiming prizes. Any net
26 proceeds remaining after paying prizes may be donated by
27 residents or clients who organize the games to projects or
28 activities of their choice. Any county or municipality that
29 regulates the playing of bingo must exempt bingo games
30 conducted pursuant to this section from regulation and fees.
31 Section 2. This act shall take effect July 1, 2002.

2 SENATE SUMMARY
3 Authorizes bingo games at nursing homes, assisted living
facilities, adult day care centers, intermediate care
4 facilities for the developmentally disabled, multiservice
senior centers, and certain government-financed or
5 government-insured housing, for residents or clients and
their guests, provided the games are conducted by
6 residents, staff, or volunteers and neither the facility
nor any third party benefits financially. Prohibits
7 nonresidents from claiming prizes. Authorizes donation of
proceeds by residents or clients to projects or
8 activities of their choice. Exempts such games from
county and municipal regulation and fees.
