1 A bill to be entitled
2 An act relating to recreational activities at
3 facilities for elderly or disabled adults;
4 authorizing bingo games for residents or
5 clients of certain facilities for the elderly
6 or disabled, and their guests; providing
7 conditions; providing for use of proceeds;
8 providing exemption from local regulation and
9 fees; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Notwithstanding the provisions of section
14 849.0931, Florida Statutes, bingo games for residents or
15 clients of a facility licensed or authorized under part II,
16 part III, part V, or part XI of chapter 400, Florida Statutes,
17 chapter 651, Florida Statutes, or section 430.206, Florida
18 Statutes, and their guests, or for residents of
19 government-financed or government-insured housing for the
20 elderly and their guests, may be conducted if such games are
21 held in the facility, played exclusively by residents or
22 clients and their guests, and conducted by residents, staff,
23 or volunteers of the facility, and if neither the facility nor
24 any third party derives financial benefit from such games.
25 Prizes may be claimed only by residents or clients of these
26 facilities or by guests who are residents or clients of other
27 similarly licensed or authorized facilities. Any net proceeds
28 remaining after paying prizes may be donated by residents or
29 clients who organize the games to projects or activities of
30 their choice. Any county or municipality that regulates the

1 playing of bingo must exempt bingo games conducted pursuant to
2 this section from regulation and fees.
3 Section 2. This act shall take effect July 1, 2002.

8 The CS differs from the bill as filed in that it specifies
that prizes from bingo games authorized by this bill may only
9 be claimed by residents or clients of these facilities, or by
guests who are residents or clients of other similarly
10 licensed or authorized facilities.
