  2         An act relating to motor vehicle license

  3         plates; amending s. 320.089, F.S.; increasing

  4         the amount of revenue deposited into the Grants

  5         and Donations Trust Fund from the sale of

  6         license plates stamped with the words "National

  7         Guard," "Pearl Harbor Survivor,"

  8         "Combat-wounded veteran," or "U.S. Reserve";

  9         providing for the issuance, without payment of

10         the license tax, of Pearl Harbor Survivor

11         license plates or Purple Heart license plates

12         to certain disabled veterans; amending s.

13         320.08058, F.S.; revising the date after which

14         a newly created collegiate license plate is

15         subject to the requirements of s. 320.08053,

16         F.S.; providing an effective date.

18  Be It Enacted by the Legislature of the State of Florida:

19

20         Section 1.  Section 320.089, Florida Statutes, is

21  amended to read:

22         320.089  Members of National Guard and active United

23  States Armed Forces reservists; former prisoners of war;

24  survivors of Pearl Harbor; Purple Heart medal recipients;

25  special license plates; fee.--

26         (1)(a)  Each owner or lessee of an automobile or truck

27  for private use or recreational vehicle as specified in s.

28  320.08(9)(c) or (d), which is not used for hire or commercial

29  use, who is a resident of the state and an active or retired

30  member of the Florida National Guard, a survivor of the attack

31  on Pearl Harbor, a recipient of the Purple Heart medal, or an

  1  active member of any branch of the United States Armed Forces

  2  Reserve shall, upon application to the department, accompanied

  3  by proof of active membership or retired status in the Florida

  4  National Guard, proof of membership in the Pearl Harbor

  5  Survivors Association or proof of active military duty in

  6  Pearl Harbor on December 7, 1941, proof of being a Purple

  7  Heart medal recipient, or proof of active membership in any

  8  branch of the Armed Forces Reserve, and upon payment of the

  9  license tax for the vehicle as provided in s. 320.08, be

10  issued a license plate as provided by s. 320.06, upon which,

11  in lieu of the serial numbers prescribed by s. 320.06, shall

12  be stamped the words "National Guard," "Pearl Harbor

13  Survivor," "Combat-wounded veteran," or "U.S. Reserve," as

14  appropriate, followed by the serial number of the license

15  plate. Additionally, the Purple Heart plate may have the words

16  "Purple Heart" stamped on the plate and the likeness of the

17  Purple Heart medal appearing on the plate.

18         (b)  Notwithstanding any other provision of law to the

19  contrary, beginning with fiscal year 2002-2003 2000-2001 and

20  annually thereafter, the first $100,000 $50,000 in general

21  revenue generated from the sale of license plates issued under

22  this section which are stamped with the words "National

23  Guard," "Pearl Harbor Survivor," "Combat-wounded veteran," or

24  "U.S. Reserve" shall be deposited into the Grants and

25  Donations Trust Fund, as described in s. 296.38(2), to be used

26  for the purposes established by law for that trust fund.

27         (c)  Notwithstanding any provisions of law to the

28  contrary, an applicant for a Pearl Harbor Survivor license

29  plate or a Purple Heart license plate who also qualifies for a

30  disabled veteran's license plate under s. 320.084 shall be

  1  issued the appropriate special license plate without payment

  2  of the license tax imposed by s. 320.08.

  3         (2)  Each owner or lessee of an automobile for private

  4  use, truck weighing not more than 5,000 pounds, or

  5  recreational vehicle as specified in s. 320.08(9)(c) or (d),

  6  which is not used for hire or commercial use, who is a

  7  resident of the state and who is a former prisoner of war, or

  8  their unremarried surviving spouse, shall, upon application

  9  therefor to the department, be issued a license plate as

10  provided in s. 320.06, on which license plate are stamped the

11  words "Ex-POW" followed by the serial number. Each application

12  shall be accompanied by proof that the applicant meets the

13  qualifications specified in paragraph (a) or paragraph (b).

14         (a)  A citizen of the United States who served as a

15  member of the Armed Forces of the United States or the armed

16  forces of a nation allied with the United States who was held

17  as a prisoner of war at such time as the Armed Forces of the

18  United States were engaged in combat, or their unremarried

19  surviving spouse, may be issued the special license plate

20  provided for in this subsection without payment of the license

21  tax imposed by s. 320.08.

22         (b)  A person who was serving as a civilian with the

23  consent of the United States Government, or a person who was a

24  member of the Armed Forces of the United States who was not a

25  United States citizen and was held as a prisoner of war when

26  the Armed Forces of the United States were engaged in combat,

27  or their unremarried surviving spouse, may be issued the

28  special license plate provided for in this subsection upon

29  payment of the license tax imposed by s. 320.08.

30         (3)  Each owner or lessee of an automobile for private

31  use, truck weighing not more than 5,000 pounds, or

  1  recreational vehicle as specified in s. 320.08(9)(c) or (d),

  2  which is not used for hire or commercial use, who is a

  3  resident of this state and who is the unremarried surviving

  4  spouse of a recipient of the Purple Heart medal shall, upon

  5  application therefor to the department, with the payment of

  6  the required fees, be issued a license plate as provided in s.

  7  320.06, on which license plate are stamped the words "Purple

  8  Heart" and the likeness of the Purple Heart medal followed by

  9  the serial number.  Each application shall be accompanied by

10  proof that the applicant is the unremarried surviving spouse

11  of a recipient of the Purple Heart medal.

12         Section 2.  Subsection (3) of section 320.08058,

13  Florida Statutes, as amended by section 2 of chapter 2001-355,

14  Laws of Florida, is amended to read:

15         320.08058  Specialty license plates.--

16         (3)  COLLEGIATE LICENSE PLATES.--

17         (a)  The department shall develop a collegiate license

18  plate as provided in this section for state and independent

19  universities domiciled in this state. However, any collegiate

20  license plate created or established after October 1, 2002,

21  January 1, 1997, must comply with the requirements of s.

22  320.08053 and be specifically authorized by an act of the

23  Legislature. Collegiate license plates must bear the colors

24  and design approved by the department as appropriate for each

25  state and independent university.  The word "Florida" must be

26  stamped across the bottom of the plate in small letters.

27         (b)  A collegiate plate annual use fee is to be

28  distributed to the state or independent university foundation

29  designated by the purchaser for deposit in an unrestricted

30  account.  The Board of Regents shall require each state

31  university to submit a plan for approval of the expenditure of

  1  all funds so designated.  These funds may be used only for

  2  academic enhancement, including scholarships and private

  3  fundraising activities.

  4         Section 3.  This act shall take effect July 1, 2002.

  9  Provides that the date by which any collegiate license plate
    created or established after, must comply with the
10  requirements of s. 320.08053 be changed from January 1, 1997
    to October 1, 2002.
