1 A bill to be entitled
2 An act relating to community mental health
3 services; requiring that the Department of
4 Children and Family Services use certain funds
5 to expand the provision of crisis services and
6 community mental health services; requiring
7 that new funds for crisis services or community
8 mental health services be appropriated in a
9 lump-sum category; requiring that the spending
10 plan include a schedule for phasing in new
11 community mental health services; requiring the
12 department to submit reports concerning its
13 progress toward expanding community mental
14 health services; requiring that certain crisis
15 services and mental health services be provided
16 by the state's community mental health system
17 by specified dates to the extent of available
18 appropriations; providing an effective date.

20 Be It Enacted by the Legislature of the State of Florida:
21
22 Section 1. (1) Pursuant to the General Appropriations
23 Acts for the 2001-2002 and 2002-2003 fiscal years, funds
24 appropriated to the Department of Children and Family Services
25 for the purpose of expanding community mental health services
26 must be used to implement programs that emphasize crisis
27 services as defined in section 394.67(4), Florida Statutes,
28 and treatment services, rehabilitative services, support
29 services, and case-management services, as defined in section
30 394.67(16), Florida Statutes. Following the 2002-2003 fiscal
31 year, the Department of Children and Family Services must

1 continue to expand the provision of these community mental
2 health services.
3 (2) Each fiscal year, any funding increases for crisis
4 services or community mental health services that are included
5 in the General Appropriations Act shall be appropriated in a
6 "Lump-Sum" category as defined in section 216.011(1)(aa),
7 Florida Statutes. In accordance with section 216.181(6)(a),
8 Florida Statutes, the Executive Office of the Governor shall
9 require the Department of Children and Family Services to
10 submit a spending plan for the use of funds appropriated for
11 this purpose. The spending plan must include a schedule for
12 phasing-in the new community mental health services in each
13 service district of the department and must describe how the
14 new services will be integrated and coordinated with all
15 current community-based health and human services.
16 (3) On October 1, 2002, and on October 1, 2003, the
17 Department of Children and Family Services shall submit a
18 report to the Governor, the President of the Senate, and the
19 Speaker of the House of Representatives concerning the
20 progress made toward expanding the provision of community
21 mental health services as required by subsection (1) during
22 the prior fiscal year.
23 (4) By January 1, 2004, the crisis services defined in
24 section 394.67(4), Florida Statutes, shall be implemented, as
25 appropriate, in the state's public community mental health
26 system to serve children and adults who are experiencing an
27 acute mental or emotional crisis, as defined in section
28 394.67(18), Florida Statutes. By January 1, 2006, the mental
29 health services defined in section 394.67(16), Florida
30 Statutes, shall be implemented, as appropriate, in the state's
31 public community mental health system to serve adults and

1 older adults who have a severe and persistent mental illness
2 and to serve children who have a serious emotional disturbance
3 or mental illness, as defined in section 394.492(6), Florida
4 Statutes.
5 (5) The provisions of subsections (1) and (4) shall be
6 implemented to the extent of available appropriations
7 contained in the annual General Appropriations Act for such
8 purposes.
9 Section 2. This act shall take effect upon becoming a
10 law.

15 Provides that the implementation of crisis services by January
1, 2004, and the implementation of mental health services by
16 January 1, 2006, are based on available appropriations in the
annual General Appropriations Act.

Requires that funding increases for crisis services or mental
18 health services in the General Appropriations Act be specified
in a "lump-sum" category in accordance with chapter 216, F.S.
