  1                      A bill to be entitled

  2         An act relating to crimes involving public or

  3         commercial transportation; providing that it is

  4         a third-degree felony to attempt to obtain or

  5         obtain any means of public or commercial

  6         transportation or conveyance with the intent to

  7         commit a felony or facilitate the commission of

  8         a felony; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Prohibited use of a means of public or

13  commercial transportation or conveyance.--A person may not

14  attempt to obtain, solicit to obtain, or obtain any means of

15  public or commercial transportation or conveyance, including

16  any vessel, aircraft, railroad train, or commercial motor

17  vehicle defined in section 316.033(66), Florida Statutes, with

18  the intent to use the means of public or commercial

19  transportation or conveyance to commit a felony or facilitate

20  the commission of a felony. A violation of this section is a

21  felony of the third degree, punishable as provided in section

22  775.082, section 775.083, or section 775.084, Florida

23  Statutes.

24         Section 2.  This act shall take effect October 1, 2002.

27                          SENATE SUMMARY

28    Provides that it is a felony of the third degree to
      attempt to obtain, solicit, or obtain any means of public
29    or commercial transportation or conveyance with the
      intent to use the means of public or commercial
30    transportation or conveyance to commit a felony or
