13         Senate Amendment (with title amendment) 

14         On page 15, between lines 25 and 26,

15

16   insert:

17         Section 11.  Section 893.065, Florida Statutes, is

18  created to read:

19         Section 893.065  Voluntary program for

20  counterfeit-resistant prescription blanks.--The Department of

21  Legal Affairs, may, by rule, after consultation with the

22  prescription monitoring program advisory council established

23  under this act, develop a voluntary program for

24  counterfeit-resistant prescription blanks to be used by

25  practitioners who prescribe controlled substances or any drug

26  of abuse under the electronic prescription-monitoring system

27  which has been designated by the Attorney General. The

28  Department of Legal Affairs may develop, by rule, a

29  counterfeit-resistant prescription blank for voluntary use by

30  practitioners who prescribe controlled substances or any drug

31  of abuse under the electronic prescription monitoring system.

  1  The Department of Legal Affairs may, by rule, require the

  2  blanks to be printed on distinctive paper, serially numbered,

  3  and to bear the preprinted name, address, and category of

  4  professional licensure of the practitioner to whom they are

  5  issued and that practitioner's federal registry number for

  6  controlled substances. The prescription blanks may be issued

  7  by the Department of Legal Affairs in serially numbered groups

  8  to prescribing practitioners. If such blanks are issued by the

  9  Department of Legal Affairs to implement a voluntary program

10  for counterfeit-resistant prescription blanks, a copy must be

11  available for inspection by the Department of Legal Affairs,

12  and all costs of preparing, issuing, and tracking prescription

13  blanks may be covered by the Department of Legal Affairs.

27         substances and drugs; granting rulemaking

28         authority to the Department of Legal Affairs;

29         providing inspection of such forms by the

30         Department of Legal Affairs;
