  1                      A bill to be entitled

  2         An act relating to restriction on employment of

  3         relatives by individual school board members;

  4         amending s. 230.23, F.S.; prohibiting

  5         individual school board members from

  6         appointing, employing, contracting with,

  7         promoting, or advancing a relative of such

  8         school board members; providing an effective

  9         date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Paragraph (h) is added to subsection (5) of

14  section 230.23, Florida Statutes, to read:

15         230.23  Powers and duties of school board.--The school

16  board, acting as a board, shall exercise all powers and

17  perform all duties listed below:

18         (5)  PERSONNEL.--Designate positions to be filled,

19  prescribe qualifications for those positions, and provide for

20  the appointment, compensation, promotion, suspension, and

21  dismissal of employees as follows, subject to the requirements

22  of chapter 231:

23         (h)  Employees and relatives.--Notwithstanding any

24  provisions of law to the contrary, provide that an individual

25  school board member may not appoint, employ, contract with,

26  promote, or advance an individual who is a relative of such

27  individual school board member.  For purposes of this

28  paragraph, "relative" is defined pursuant to s. 112.3135.

29         Section 2.  This act shall take effect July 1, 2002.
