2 An act relating to public records and meetings;
3 creating s. 246.1112, Florida Statutes;
4 exempting certain investigatory records of the
5 Commission for Independent Education; providing
6 for future review and repeal; providing an
7 effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 246.1112, Florida Statutes, is
12 created to read:
13 246.1112 Actions against a licensee and other
14 penalties; confidentiality of information.--The complaint and
15 all information obtained by the Commission for Independent
16 Education in the course of an investigation under s. 246.111
17 is confidential and exempt from s. 119.07(1), and s. 24(a),
18 Art. I of the State Constitution, for a maximum of 10 days
19 after the probable-cause panel declares a finding of probable
20 cause, and the proceedings of that probable-cause panel are
21 exempt from s. 286.011 and s. 24(b), Art. I of the State
22 Constitution until the panel declares a finding of probable
23 cause. This section is subject to the Open Government Sunset
24 Review Act of 1995 in accordance with s. 119.15, and shall
25 stand repealed October 2, 2007, unless renewed and saved from
26 repeal through reenactment by the Legislature.
27 Section 2. This act shall take effect January 7, 2003.
