1 A bill to be entitled
2 An act relating to fire hydrants; requiring
3 owners of private fire hydrants to contract
4 with licensed professionals or local fire
5 control authorities to inspect and service such
6 hydrants; providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. (1) A person who owns a private fire
11 hydrant must ensure that the hydrant is installed in
12 compliance with the provisions of National Fire Protection
13 Association Standard 24, Standard for the Installation of
14 Private Fire Service Mains and Their Appurtenances, and is
15 inspected and maintained in compliance with the provisions of
16 National Fire Protection Association Standard 25, Standard for
17 the Inspection, Testing, and Maintenance of Water-Based Fire
18 Protection Systems, the edition currently adopted by the State
19 Fire Marshal pursuant to its code and standards-adoption
20 authority in chapter 633, Florida Statutes. A person who owns
21 a private fire hydrant must produce, upon request of the fire
22 official, a valid and continuing maintenance contract with a
23 plumbing contractor licensed under chapter 489, Florida
24 Statutes, an underground utility contractor licensed under
25 chapter 489, Florida Statutes, or, if the private hydrant is
26 part of a fire suppression system, a fire protection
27 contractor licensed under chapter 633, Florida Statutes. Upon
28 failure to produce a valid maintenance contract as provided in
29 this section, the owner must contract with the local
30 government fire control authority that serves the property

1 where the fire hydrant is located to inspect and service the
2 fire hydrant annually.
3 (2) A person who violates this section is guilty of a
4 noncriminal violation, punishable by a fine not to exceed $100
5 for a first offense or $250 for each subsequent offense.
6 Section 2. This act shall take effect July 1, 2002.

11 This CS differs from the bill as filed in that it requires
owners of private fire hydrants to ensure the hydrant is
12 installed, maintained and inspected properly, and to produce,
upon request, a valid and continuing maintenance contract for
13 the hydrant.
