  1                      A bill to be entitled

  2         An act relating to federal aid; amending s.

  3         339.12, F.S.; providing that certain counties

  4         levying specified local option taxes shall

  5         receive preference for receipt of any

  6         transportation grant for which the county

  7         applies; providing for applicability; providing

  8         an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsection (10) is added to section 339.12,

13  Florida Statutes, to read:

14         339.12  Aid and contributions by governmental entities

15  for department projects; federal aid.--

16         (10)  Any county having a population greater than

17  50,000 which levies the full 6 cents of local option fuel tax

18  pursuant to ss. 206.41(1)(e) and 206.87(1)(c), and which

19  dedicates 35 percent or more of its discretionary sales

20  surtax, pursuant to s. 212.055, for improvements to the State

21  Transportation System or to local projects directly upgrading

22  the State Transportation System within the county's boundaries

23  shall receive preference for receipt of any transportation

24  grant for which the county applies.  This subsection shall not

25  apply to loans or nonhighway grant programs.

26         Section 2.  This act shall take effect July 1, 2002.

                       COMMITTEE SUBSTITUTE FOR
  2                         Senate Bill 676

  4  The CS provides certain counties with over 50,000 in
    population that levy the full 6 cents of local option fuel tax
  5  and dedicate 35 percent or more of its discretionary sales
    surtax for for improvements to the State Transportation
  6  System, or to local projects directly upgrading the State
    Transportation System within the county's boundaries, will
  7  receive preference for transportation grants.
