1 A bill to be entitled
2 An act for the relief of Howard L. Miller;
3 providing an appropriation to compensate him
4 for losses sustained as a result of actions of
5 the Parole Commission; providing an effective
6 date.

8 WHEREAS, Howard L. Miller was an employee of the Parole
9 Commission from June 1960 through December 1993, and
10 WHEREAS, Howard L. Miller was demoted as a result of
11 receiving conditional performance evaluations spanning 120
12 days, effective August 16, 1982, and
13 WHEREAS, the Parole Commission, on August 19, 1982,
14 accepted Mr. Miller's Voluntary Request For Demotion wherein
15 Mr. Miller agreed to a reduction in pay from $25,750.52 to
16 $25,164.58 per year effective September 3, 1982, and agreed
17 that the 7-percent annual legislative increase that would take
18 effect September 1, 1982, would not be added to the
19 $25,164.58, and
20 WHEREAS, Howard L. Miller did not voluntarily sign the
21 request for demotion, and
22 WHEREAS, Howard L. Miller received notice from the
23 Parole Commission on June 23, 1999, that the performance
24 evaluations dated April 7, June 7, August 5, and August 12,
25 1982, had been placed in an official personnel file in an
26 unsealed envelope marked invalid, and
27 WHEREAS, as a result of inappropriate actions by the
28 Parole Commission, Howard L. Miller has suffered economic
29 damages, NOW, THEREFORE,

31 Be It Enacted by the Legislature of the State of Florida:

1 Section 1. The facts stated in the preamble to this
2 act are found and declared to be true.
3 Section 2. There is appropriated from the General
4 Revenue Fund to the Parole Commission the sum of $__________
5 for the relief of Howard L. Miller for injuries and damages
6 sustained.
7 Section 3. The Comptroller is directed to draw a
8 warrant in favor of Howard L. Miller in the total sum of
9 $__________ upon funds of the Parole Commission in the State
10 Treasury, and the State Treasurer is directed to pay the same
11 out of such funds in the State Treasury.
12 Section 4. This act shall take effect upon becoming a
13 law.
