  1                      A bill to be entitled

  2         An act relating to certificates of need;

  3         amending s. 408.036, F.S.; exempting certain

  4         open-heart-surgery programs from

  5         certificate-of-need review requirements;

  6         providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

10         Section 1.  Paragraph (t) is added to subsection (3) of

11  section 408.036, Florida Statutes, to read:

12         408.036  Projects subject to review.--

13         (3)  EXEMPTIONS.--Upon request, the following projects

14  are subject to exemption from the provisions of subsection

15  (1):

16         (t)  For the provision of adult open-heart surgery

17  services in a hospital. The applicant must certify that it

18  will provide a minimum of 2 percent of such services to

19  charity or Medicaid patients.

20         Section 2.  This act shall take effect upon becoming a

21  law.

24                          SENATE SUMMARY

25    Exempts provision of adult open-heart-surgery services in
      a hospital from certificate-of-need review when the
26    hospital certifies that it will provide at least 2
      percent of such services to charity or Medicaid patients.
