  2         An act relating to certificates of need;

  3         amending s. 408.043, F.S.; providing criteria

  4         for review of a certificate-of-need application

  5         for establishment of an adult open heart

  6         surgery program in a county in which none of

  7         the hospitals has an existing or approved adult

  8         open heart surgery program and another program

  9         is not located nearby; providing an effective

10         date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  Subsection (5) is added to section 408.043,

15  Florida Statutes, to read:

16         408.043  Special provisions.--

17         (5)  OPEN HEART SURGERY.--When an application is made

18  for a certificate of need to establish an adult open heart

19  surgery program in a county in which none of the hospitals has

20  an existing or approved adult open heart surgery program and

21  there is no existing or approved program located within 30

22  miles, need shall be evaluated under special circumstances to

23  promote reasonable access to such a program within the county.

24  The criteria on which the certificate of need is reviewed in

25  such circumstances shall favor approval in those counties that

26  can support a designated minimum projected volume of residents

27  discharged with a principal diagnosis of ischemic heart

28  disease. County-specific need identified under these

29  circumstances shall exist independently of and in addition to

30  any district need identified under the standard numeric need

31  formula.

  1         Section 2.  This act shall take effect upon becoming a

  2  law.

  4          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
  5                          CS for SB 698

  7  Deletes the provision which exempted from Certificate-of-Need
    (CON) review requirements specified acute care beds and
  8  neonatal intensive care unit beds in hospitals that met
    certain occupancy criteria.

    Deletes the provision which exempted from CON review specified
10  projects that are currently subject to an expedited CON
    review.

    Revises criteria relating to an adult open heart surgery
12  program by creating special circumstances provisions in the
    CON review process for a hospital applying for such a program
13  in a county in which none of the hospitals has an existing or
    approved adult open heart surgery program and there is no
14  existing or approved program located within 30 miles.
