18 employment. This section is not intended to preempt or
19 prevent any other background screening, including but not
20 limited to criminal history record checks, that a county may
21 lawfully undertake.
22 Section 2. Section 166.0442, Florida Statutes, is
23 created to read:
24 166.0442 Criminal history record checks for certain
25 municipal employees, contractors, and
26 appointees.--Notwithstanding chapter 435, a municipality may
27 require, by ordinance, employment screening for any position
28 of municipal employment or appointment deemed to be critical
29 to security or public safety by the governing body of the
30 municipality, or for any private contractor, employee of a
31 private contractor, vendor, repair person, or delivery person

1 who has access to any public facility or publicly operated
2 facility that is deemed to have critical security or public
3 safety status by the governing body of the municipality. The
4 ordinance shall require each person applying for any such
5 position to be fingerprinted. These fingerprints shall be
6 submitted to the Department of Law Enforcement for a state
7 criminal history record check and to the Federal Bureau of
8 Investigation for a national criminal history record check.
9 The information obtained from the criminal history record
10 checks conducted pursuant to the ordinance may be used by the
11 municipality to determine the applicant's eligibility for
12 employment. This section is not intended to preempt or
13 prevent any other background screening, including but not
14 limited to criminal history record checks, that a municipality
15 may lawfully undertake.
