12 Affairs recommended the following amendment:

15 On page 2, between lines 9 and 10,

17 insert:
18 Section 2. Subsections (1) and (2) of section 316.189,
19 Florida Statutes, are amended to read:
20 316.189 Establishment of municipal and county speed
21 zones.--
22 (1) MUNICIPAL SPEED.--The maximum speed within any
23 municipality is 30 miles per hour. With respect to residence
24 districts, a municipality may set a maximum speed limit of 20
25 or 25 miles per hour on local streets and highways after an
26 investigation determines that such a limit is reasonable. It
27 shall not be necessary to conduct a separate investigation for
28 each residence district. A municipality may set speed zones
29 altering the speed limit, both as to maximum, not to exceed 60
30 miles per hour, and minimum, after investigation determines
31 such a change is reasonable and in conformity to criteria

1 promulgated by the Department of Transportation. A
2 municipality may lower speed limits set by the Department of
3 Transportation, except that no changes shall be made on
4 non-limited-access state highways or connecting links or
5 extensions thereof located within the municipality by not more
6 than 5 miles per hour, when such change is reasonable and in
7 conformity with criteria promulgated by the Department of
8 Transportation or based upon traffic or engineering study
9 conducted by the affected local government; however, the limit
10 may not be reduced below 45 miles per hour. A municipality
11 that reduces the speed limit on a non-limited-access state
12 highway or connecting link or extension thereof shall
13 reimburse the Department of Transportation for the cost of
14 installing, maintaining, and replacing all traffic-control
15 devices required to post the reduced speed limit, which shall
16 be changed only by the Department of Transportation.
17 (2) SPEED ON COUNTY ROADS.--The maximum speed on any
18 county-maintained road is:
19 (a) In any business or residence district, 30 miles
20 per hour in the daytime or nighttime; provided that with
21 respect to residence districts a county may set a maximum
22 speed limit of 25 miles per hour after an investigation
23 determines that such a limit is reasonable; and it shall not
24 be necessary to conduct a separate investigation in each
25 residence district.
26 (b) On any other part of a county road not a business
27 or residence district, as set forth in s. 316.183.

29 However, the board of county commissioners may set speed zones
30 altering such speeds, both as to maximum and minimum, after
31 investigation determines such a change is reasonable and in

1 conformity to criteria promulgated by the Department of
2 Transportation, except that no such speed zone shall permit a
3 speed of more than 60 miles per hour. A county may lower speed
4 limits set by the Department of Transportation on
5 non-limited-access state highways or connecting links or
6 extensions thereof located within the county by not more than
7 5 miles per hour, when such change is reasonable and in
8 conformity with criteria promulgated by the Department of
9 Transportation or based upon a traffic or engineering study
10 conducted by the affected local government; however, the limit
11 may not be reduced below 45 miles per hour. A county that
12 reduces the speed limit on a non-limited-access state highway
13 or connecting link or extension thereof shall reimburse the
14 Department of Transportation for the cost of installing,
