3 119.07, F.S.; providing that electronic paging
4 device numbers of law enforcement officers and
5 former law enforcement officers used in the
6 course of their employment and the billing
7 records of such electronic paging device
8 numbers are exempt from public records
9 requirements; providing for future review and
10 repeal; providing a statement of public
11 necessity; providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Paragraph (ee) is added to subsection (3)
16 of section 119.07, Florida Statutes, to read:
17 119.07 Inspection, examination, and duplication of
18 records; exemptions.--
19 (3)
20 (ee) The electronic paging device number of a law
21 enforcement officer or former law enforcement officer used in
22 the course of the officer's employment in this state and the
23 billing records of such electronic paging device numbers are
24 exempt from the provisions of subsection (1) and s. 24(a),
25 Art. I of the State Constitution. This paragraph is subject to
26 the Open Government Sunset Review Act of 1995, in accordance
27 with s. 119.15, and shall stand repealed on October 2, 2003,
28 unless reviewed and saved from repeal through reenactment by
29 the Legislature.
30 Section 2. The Legislature finds that the exemption
31 from public records requirements provided by this act is a

1 public necessity because law enforcement officers or former
2 law enforcement officers can be identified as such by
3 connecting them with the electronic paging device numbers that
4 are or have been used in the course of their employment. The
5 identification of law enforcement officers through electronic
6 paging device numbers and the billing records of such
7 electronic paging device numbers can compromise
8 investigations, undermine those officers' ability to apprehend
9 suspects, and compromise the physical safety of law
10 enforcement officers. Electronic paging device numbers of
11 former law enforcement officers and the billing records of
12 such electronic paging device numbers, if made public, could
13 also jeopardize ongoing investigations, law enforcement
14 informers and contacts, as well as the safety of former law
15 enforcement officers because such numbers could be used to
16 connect a former law enforcement officer to an investigation.
17 Consequently, the Legislature finds that electronic paging
18 device numbers of law enforcement officers and former law
19 enforcement officers used in the course of their employment
20 and the billing records of such electronic paging device
21 numbers must be kept exempt.
22 Section 3. This act shall take effect upon becoming a
23 law.
