19 Section 1. (1) Pursuant to the General Appropriations
20 Acts for the 2001-2002 and 2002-2003 fiscal years, funds
21 appropriated to the Department of Children and Family Services
22 for the purpose of expanding community mental health services
23 must be used to implement programs that emphasize crisis
24 services as defined in section 394.67(4), Florida Statutes,
25 and treatment services, rehabilitative services, support
26 services, and case-management services, as defined in section
27 394.67(16), Florida Statutes. Following the 2002-2003 fiscal
28 year, the Department of Children and Family Services must
29 continue to expand the provision of these community mental
30 health services.
31 (2) In order to estimate the cost of the expansion of

1 community mental health services, the Department of Children
2 and Families in collaboration with the Agency for Health Care
3 Administration shall develop, and update annually, estimates
4 of the need for mental health services including forecasts of
5 Baker Act expenditures based on periodic actuarial analysis,
6 caseload estimates of adults with serious mental illness and
7 children with serious emotional disturbance, the associated
8 costs per person served and recommendations for maximizing the
9 use of federal funds to meet these needs. The estimate will be
10 submitted to the Executive Office of the Governor, the
11 President of the Senate and the Speaker of the House on August
12 1 of each year.
13 (3) Each fiscal year, any funding increases for crisis
14 services or community mental health services that are included
15 in the General Appropriations Act shall be appropriated in a
16 "Lump-Sum" category as defined in section 216.011(1)(aa),
17 Florida Statutes. In accordance with section 216.181(6)(a),
18 Florida Statutes, the Executive Office of the Governor shall
19 require the Department of Children and Family Services to
20 submit a spending plan for the use of funds appropriated for
21 this purpose. The spending plan must include a schedule for
22 phasing-in the new community mental health services in each
23 service district of the department and must describe how the
24 new services will be integrated and coordinated with all
25 current community-based health and human services.
26 (4) On October 1, 2002, and on October 1, 2003, the
27 Department of Children and Family Services shall submit a
28 report to the Governor, the President of the Senate, and the
29 Speaker of the House of Representatives concerning the
30 progress made toward expanding the provision of community
31 mental health services as required by subsection (1) during

1 the prior fiscal year.
2 (5) By January 1, 2004, the crisis services defined in
3 section 394.67(4), Florida Statutes, shall be implemented, as
4 appropriate, in the state's public community mental health
5 system to serve children and adults who are experiencing an
6 acute mental or emotional crisis, as defined in section
7 394.67(18), Florida Statutes. By January 1, 2006, the mental
8 health services defined in section 394.67(16), Florida
9 Statutes, shall be implemented, as appropriate, in the state's
10 public community mental health system to serve adults and
11 older adults who have a severe and persistent mental illness
12 and to serve children who have a serious emotional disturbance
13 or mental illness, as defined in section 394.492(6), Florida
14 Statutes.
15 (6) The provisions of subsections (1) and (4) shall be
16 implemented to the extent of available appropriations
17 contained in the annual General Appropriations Act for such
18 purposes.
19 Section 2. This act shall take effect upon becoming a
20 law.
