13         Amendment (with title amendment) 

14         On page 87, between lines 2 and 3, of the bill

15

16  insert:

17         Section 51.  Paragraph (d) is added to subsection (10)

18  of section 768.28, Florida Statutes, to read:

19         768.28  Waiver of sovereign immunity in tort actions;

20  recovery limits; limitation on attorney fees; statute of

21  limitations; exclusions; indemnification; risk management

22  programs.--

24         (d)  For the purposes of this section, operators,

25  dispatchers, and providers of security for rail services and

26  rail facility maintenance providers in the South Florida Rail

27  Corridor, or any of their employees or agents, performing such

28  services under contract with and on behalf of the Tri-County

29  Commuter Rail Authority or the Department of Transportation

30  shall be considered agents of the state while acting within

31  the scope of and pursuant to guidelines established in said

  9         amending s. 768.28, F.S.; providing that

10         certain operators, dispatchers, and security

11         providers for rail services and certain rail

12         facility maintenance providers in a specified

13         area or for the Tri-County Commuter Rail

14         Authority or the Department of Transportation

15         are agents of the state under specified

16         circumstances;
