1 House Joint Resolution
2 A joint resolution proposing an amendment to
3 Section 7 of Article III of the State
4 Constitution, relating to the passage of bills
5 by the Legislature, to require a specified
6 review period for proposed legislation prior to
7 final passage.

9 Be It Resolved by the Legislature of the State of Florida:

11 That the amendment to Section 7 of Article III of the
12 State Constitution set forth below is agreed to and shall be
13 submitted to the electors of Florida for approval or rejection
14 at the general election to be held in November 2002:
15 SECTION 7. Passage of bills.--Any bill may originate
16 in either house and after passage in one may be amended in the
17 other. It shall be read in each house on three separate days,
18 unless this rule is waived by two-thirds vote; provided the
19 publication of its title in the journal of a house shall
20 satisfy the requirement for the first reading in that house.
21 On each reading, it shall be read by title only, unless
22 one-third of the members present desire it read in full. With
23 the exception of general appropriation bills, including
24 conference reports therefor, subject to the seventy-two hour
25 public review period pursuant to Section 19 of this Article,
26 and with the exception of concurrent resolutions or
27 resolutions relating to extension of a session or legislative
28 organization or procedures, all bills, joint resolutions,
29 concurrent resolutions, resolutions, memorials, and conference
30 reports shall be furnished in their final form to each member
31 of the house hearing the measure at least forty-eight hours

1 prior to final passage by that house of the legislature. For
2 purposes of the forty-eight hour period, the term "final form"
3 does not prohibit correction by technical, nonsubstantive
4 amendment. On final passage, the vote of each member voting
5 shall be entered on the journal. Passage of a bill shall
6 require a majority vote in each house. Each bill and joint
7 resolution passed in both houses shall be signed by the
8 presiding officers of the respective houses and by the
9 secretary of the senate and the clerk of the house of
10 representatives during the session or as soon as practicable
11 after its adjournment sine die.
12 BE IT FURTHER RESOLVED that in accordance with the
13 requirements of s. 101.161, Florida Statutes, the title and
14 substance of the amendment proposed herein shall appear on the
15 ballot as follows:
16 REVIEW PERIOD FOR PROPOSED LEGISLATION
17 BEFORE FINAL PASSAGE; EXEMPTIONS
18 Requires all bills, joint resolutions, concurrent
19 resolutions, resolutions, memorials, and conference reports to
20 be furnished in their final form, subject to technical,
21 nonsubstantive amendments, to each member of the house hearing
22 the measure at least forty-eight hours prior to final passage
23 by that house of the Legislature. Exempts all general
24 appropriation bills and their conference reports, which are
25 subject to a separate seventy-two hour public review period
26 under the State Constitution, and exempts concurrent
27 resolutions or resolutions relating to extension of a session
28 or legislative organization or procedures.
