16 insert: 443.036 Definitions.--As used in this chapter,
17 unless the context clearly requires otherwise:
18 (7) BASE PERIOD.--
19 (a) "Base period" means the first four of the last
20 five completed calendar quarters immediately preceding the
21 first day of an individual's benefit year.
22 (b) With respect to a benefit year commencing on or
23 after October 1, 2002, if an individual is not monetarily
24 eligible in his or her base period to qualify for benefits,
25 the division must designate his or her base period to be the
26 alternative base period. As used in this paragraph, the term
27 "alternative base period" means the last four completed
28 calendar quarters immediately preceding the first day of an
29 individual's benefit year. Wages used in a base period to
30 establish a monetarily eligible benefit year may not be
31 applied to establish monetary eligibility in any succeeding

1 benefit year. If information regarding wages for the calendar
2 quarter or quarters immediately preceding the benefit year has
3 not been input into the division's mainframe database from the
4 regular quarterly reports of wage information or is otherwise
5 unavailable, the division shall request such information from
6 the employer. An employer must provide the requested wage
7 information within 10 days after receiving a request from the
8 division. An employer who fails to provide the requested wage
9 information within the required time is subject to the penalty
10 for delinquent reports in s. 443.141(1)(b).
11 (c) For monetary determinations based upon the
12 alternative base period under paragraph (b), if the division
13 is unable to access the wage information through its mainframe
14 database, the division may base the determination of
15 eligibility for benefits on an affidavit submitted by the
16 individual with respect to wages for those calendar quarters.
17 The individual must furnish payroll information, if available,
18 in support of the affidavit. A determination of benefits based
19 upon an alternative base period shall be adjusted when the
20 quarterly report of wage information from the employer is
21 received, if that information causes a change in the
22 determination.
