19 Be It Enacted by the Legislature of the State of Florida:

21 Section 1. Section 231.265, Florida Statutes, is
22 created to read:
23 231.265 Failure to report certain offenses;
24 penalty.--If any instructional personnel or administrative
25 personnel has knowledge that a sexual battery has been
26 committed by a student upon another student and fails to
27 report the offense to a law enforcement agency having
28 jurisdiction over the school plant, or over the place where
29 the sexual battery occurred if not on the grounds of the
30 school plant, that failure constitutes a misdemeanor of the
31 first degree, punishable as provided in s. 775.082 or s.
