17 Section 1. Effective January 7, 2003, all powers,
18 duties, functions, rules, records, personnel, property, and
19 unexpended balances of appropriations, allocations, or other
20 funds of the Correctional Privatization Commission, as created
21 in chapter 957, Florida Statutes, are transferred to the
22 office of the chief financial officer by a type one transfer,
23 as defined in section 20.06(2), Florida Statutes.
24 Section 2. Subsections (1) and (6) of section 957.03,
25 Florida Statutes, are amended to read:
26 957.03 Correctional Privatization Commission.--
27 (1) COMMISSION.--The Correctional Privatization
28 Commission is created within the office of the chief financial
29 officer for the purpose of entering into contracts with
30 contractors for the designing, financing, acquiring, leasing,
31 constructing, and operating of private correctional

1 facilities. For administrative purposes, the commission is
2 created within the Department of Management Services. The
3 commission may enter into contracts with contractors for the
4 designing, financing, acquiring, leasing, and constructing of
5 private juvenile commitment facilities.
6 (6) OFFICE OF THE CHIEF FINANCIAL OFFICER SUPPORT BY
7 DEPARTMENT OF MANAGEMENT SERVICES.--The commission shall be a
8 separate budget entity, and the executive director shall be
9 its chief administrative officer. The office of the chief
10 financial officer Department of Management Services shall
11 provide administrative support, oversight, and service to the
12 commission to the extent requested by the executive director.
13 The commission and its staff are not subject to control,
14 supervision, or direction by the Department of Management
15 Services in any manner, including, but not limited to,
16 personnel, purchasing, and budgetary matters, except to the
17 extent as provided in chapters 110, 216, 255, 282, and 287 for
18 agencies of the executive branch. The executive director may
19 designate a maximum of two policymaking or managerial
20 positions as being exempt from the Career Service System.
21 These two positions may be provided for as members of the
22 Senior Management Service.
23 Section 3. This act shall take effect January 7, 2003.
