1 A bill to be entitled
2 An act relating to trust funds; re-creating the
3 Privately Operated Institutions Inmate Welfare
4 Trust Fund within the Department of Corrections
5 without modification; carrying forward current
6 balances and continuing current sources and
7 uses thereof; repealing s. 944.72(3), F.S.,
8 relating to termination and review of the trust
9 fund, to conform; providing an effective date.

11 WHEREAS, the Legislature wishes to extend the life of
12 the Privately Operated Institutions Inmate Welfare Trust Fund
13 within the Department of Corrections, which is otherwise
14 scheduled to be terminated pursuant to constitutional mandate,
15 and
16 WHEREAS, the Legislature has reviewed the trust fund
17 before its scheduled termination date and has found that it
18 continues to meet an important public purpose, and
19 WHEREAS, the Legislature has found that existing public
20 policy concerning the trust fund sets adequate parameters for
21 its use, NOW, THEREFORE,

23 Be It Enacted by the Legislature of the State of Florida:
24
25 Section 1. (1) The Privately Operated Institutions
26 Inmate Welfare Trust Fund within the Department of
27 Corrections, FLAIR number 70-2-623, which is to be terminated
28 pursuant to Section 19(f), Article III of the State
29 Constitution on July 1, 2002, is re-created.

1 (2) All current balances of the trust fund are carried
2 forward, and all current sources and uses of the trust fund
3 are continued.
4 Section 2. Subsection (3) of section 944.72, Florida
5 Statutes, is repealed.
6 Section 3. This act shall take effect July 1, 2002.
