15         On page 17, line 16, delete that line

17  and insert:  considered late, unless, in the opinion of the

18  division or the board, exceptional circumstances beyond an

19  employer's control prevented remittance by the prescribed due

20  date notwithstanding the employer's good-faith efforts to

21  effect delivery. A waiver of delinquency by the division or

22  the board may be granted an employer only one time each fiscal

23  year. The employer shall be assessed a penalty of 1
