13         Substitute Amendment to Amendment (542317) (with title

14  amendment) 

15         On page 2, line 31,

17  insert:

18         Section 1.  Paragraph (b) of subsection (2) of section

19  121.0515, Florida Statutes, is amended to read:

20         121.0515  Special risk membership.--

21         (2)  CRITERIA.--A member, to be designated as a special

22  risk member, must meet the following criteria:

23         (b)  The member must be employed as a firefighter and

24  be certified, or required to be certified, in compliance with

25  s. 633.35 and be employed solely within the fire department of

26  a local government employer or an agency of state government

27  with firefighting responsibilities. In addition, the member's

28  duties and responsibilities must include on-the-scene fighting

29  of fires, fire prevention, or firefighter training; direct

30  supervision of firefighting units, fire prevention, or

31  firefighter training; or aerial firefighting surveillance

  1  performed by fixed-wing aircraft pilots employed by the

  2  Division of Forestry of the Department of Agriculture and

  3  Consumer Services; or the member must be the supervisor or

  4  command officer of a member or members who have such

  5  responsibilities; provided, however, administrative support

  6  personnel, including, but not limited to, those whose primary

  7  duties and responsibilities are in accounting, purchasing,

  8  legal, and personnel, shall not be included; and further

  9  provided that all periods of creditable service in fire

10  prevention or firefighter training, or as the supervisor or

11  command officer of a member or members who have such

12  responsibilities, and for which the employer paid the special

13  risk contribution rate, shall be included.

21         amending s. 121.0515, F.S.; revising language

22         with respect to special risk membership in the
