18 Section 1. Paragraph (b) of subsection (3) of section
19 311.07, Florida Statutes, is amended to read:
20 311.07 Florida seaport transportation and economic
21 development funding.--
22 (3)
23 (b) Projects eligible for funding by grants under the
24 program are limited to the following port facilities or port
25 transportation projects:
26 1. Transportation facilities within the jurisdiction
27 of the port.
28 2. The dredging or deepening of channels, turning
29 basins, or harbors.
30 3. The construction or rehabilitation of wharves,
31 docks, structures, jetties, piers, storage facilities, cruise

1 terminals, automated people mover systems, or any facilities
2 necessary or useful in connection with any of the foregoing.
3 4. The acquisition of container cranes or other
4 mechanized equipment used in the movement of cargo or
5 passengers in international commerce.
6 5. The acquisition of land to be used for port
7 purposes.
8 6. The acquisition, improvement, enlargement, or
9 extension of existing port facilities.
10 7. Environmental protection projects which are
11 necessary because of requirements imposed by a state agency as
12 a condition of a permit or other form of state approval; which
13 are necessary for environmental mitigation required as a
14 condition of a state, federal, or local environmental permit;
15 which are necessary for the acquisition of spoil disposal
16 sites and improvements to existing and future spoil sites; or
17 which result from the funding of eligible projects listed in
18 this paragraph herein.
19 8. Transportation facilities as defined in s.
20 334.03(31) which are not otherwise part of the Department of
21 Transportation's adopted work program.
22 9. Seaport intermodal access projects identified in
23 the 5-year Florida Seaport Mission Plan as provided in s.
24 311.09(3).
25 10. Construction or rehabilitation of port facilities
26 as defined in s. 315.02, excluding any park or recreational
27 facilities, in ports listed in s. 311.09(1) with operating
28 revenues of $5 million or less, provided that such projects
29 create economic development opportunities, capital
30 improvements, and positive financial returns to such ports.
31 11. Seaport security measures. Such measures include

2 a. Infrastructure security measures required by
3 seaport security plans approved by the Office of Drug Control
4 and the Department of Law Enforcement under to s. 311.12,
5 including security gates, physical barriers, and
6 security-related lighting systems, equipment, or facilities to
7 be used for seaport security monitoring and recording, remote
8 surveillance systems, concealed recording systems, or other
9 security infrastructure, technology, vulnerability assessments
10 or equipment that contributes to the overall security of the
11 seaport and its facilities as specified in the security plans
12 approved by the Office of Drug Control and the Department of
13 Law Enforcement under s. 311.12 or as otherwise specifically
14 found by the Department of Law Enforcement to be a measure
15 consistent with and supportive of such an approved plan.
16 Program funds for such measures may come from funds made
17 available under ss. 311.07(2), 320.20(3) or 320.20(4).
18 Infrastructure measures required by an approved seaport
19 security plan or as otherwise found by the Department of Law
20 Enforcement to be consistent with and supportive of an
21 approval plan as authorized herein are not subject to the
22 matching fund requirements of paragraph (a), s. 320.20(3), or
23 s. 320.20(4). This subparagraph shall expire June 30, 2004.
24 b. Law enforcement measures mandated by federal, state
25 or local governmental agencies, including the deployment of
26 the Florida National Guard, local law enforcement personnel
27 seaport security personnel, private sector security personnel,
28 or any such combination thereof to provide operational
29 security services at any seaport identified in s. 311.09(1).
30 Program funds for such measures may come from funds made
31 available under s. 311.07(2). Law enforcement measures are

1 subject to the matching fund requirements of paragraph (a),
2 except that any funds provided for the Florida National Guard
3 shall remain exempt from the matching fund requirements of
4 paragraph (a) through the period April 30, 2002. This
5 subparagraph shall expire June 30, 2004.
6 c. Notwithstanding s. 339.135(7), or any other
7 provision of law to the contrary, seaports may request the
8 department change the purpose of a project in the 2000-2001
9 and 2001-2002 work programs to a purpose authorized under s.
10 311.07(3)(b)11.
11 d. Additional consideration shall be given to seaports
12 with operating revenues of $14 million or less for operational
13 security and law enforcement measures for grants not to exceed
14 $350,000.

16 Any federal funds that are provided for port security
17 infrastructure improvements of which funds seaports in this
18 state are the beneficiaries, shall be allocated consistent
19 with federal requirements and guidelines. Federal funds
20 obtained by a seaport for a specific security infrastructure
21 project, which project has also received state seaport
22 transportation and economic development funds, shall be used
23 to reimburse the state funds received by the seaport under
24 subparagraph 11. for the specific project. These reimbursed
25 funds must be used for projects and measures authorized under
26 subparagraphs 1.-10.
27 Section 2. This act shall take effect upon becoming a
28 law.
