1 A bill to be entitled
2 An act relating to the Florida Seaport
3 Transportation and Economic Development
4 Program; amending s. 311.07, F.S.; expanding
5 the list of projects eligible for funding by
6 grant under the program; exempting certain
7 measures from matching fund requirements;
8 providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Paragraph (b) of subsection (3) of section
13 311.07, Florida Statutes, is amended to read:
14 311.07 Florida seaport transportation and economic
15 development funding.--
16 (3)(a) Program funds shall be used to fund approved
17 projects on a 50-50 matching basis with any of the deepwater
18 ports, as listed in s. 403.021(9)(b), which is governed by a
19 public body or any other deepwater port which is governed by a
20 public body and which complies with the water quality
21 provisions of s. 403.061, the comprehensive master plan
22 requirements of s. 163.3178(2)(k), and the local financial
23 management and reporting provisions of part III of chapter
24 218. Program funds also may be used by the Seaport
25 Transportation and Economic Development Council to develop
26 with the Florida Trade Data Center such trade data information
27 products which will assist Florida's seaports and
28 international trade.
29 (b) Projects eligible for funding by grants under the
30 program are limited to the following port facilities or port
31 transportation projects:

1 1. Transportation facilities within the jurisdiction
2 of the port.
3 2. The dredging or deepening of channels, turning
4 basins, or harbors.
5 3. The construction or rehabilitation of wharves,
6 docks, structures, jetties, piers, storage facilities, cruise
7 terminals, automated people mover systems, or any facilities
8 necessary or useful in connection with any of the foregoing.
9 4. The acquisition of container cranes or other
10 mechanized equipment used in the movement of cargo or
11 passengers in international commerce.
12 5. The acquisition of land to be used for port
13 purposes.
14 6. The acquisition, improvement, enlargement, or
15 extension of existing port facilities.
16 7. Environmental protection projects which are
17 necessary because of requirements imposed by a state agency as
18 a condition of a permit or other form of state approval; which
19 are necessary for environmental mitigation required as a
20 condition of a state, federal, or local environmental permit;
21 which are necessary for the acquisition of spoil disposal
22 sites and improvements to existing and future spoil sites; or
23 which result from the funding of eligible projects listed
24 herein.
25 8. Transportation facilities as defined in s.
26 334.03(31) which are not otherwise part of the Department of
27 Transportation's adopted work program.
28 9. Seaport intermodal access projects identified in
29 the 5-year Florida Seaport Mission Plan as provided in s.
30 311.09(3).

1 10. Construction or rehabilitation of port facilities
2 as defined in s. 315.02, excluding any park or recreational
3 facilities, in ports listed in s. 311.09(1) with operating
4 revenues of $5 million or less, provided that such projects
5 create economic development opportunities, capital
6 improvements, and positive financial returns to such ports.
7 11. Seaport security infrastructure measures. Such
8 measures include security gates and fencing, security-related
9 lighting systems, equipment or facilities to be used for
10 seaport security monitoring and recording, remote surveillance
11 systems, concealed video systems, or other security
12 infrastructure or equipment that contributes to the overall
13 security of the seaport and its facilities. Seaport security
14 infrastructure measures are not subject to the matching fund
15 requirements of paragraph (a).
16 Section 2. This act shall take effect July 1, 2002.
