  1                      A bill to be entitled

  2         An act relating to newborn infant screening;

  3         authorizing formation of a task force within

  4         the Division of Children's Medical Services

  5         Prevention and Intervention of the Department

  6         of Health; providing purpose; providing

  7         membership, organization, and expenses;

  8         requiring review of data and recommendations

  9         and a plan for newborn infant screening

10         requirements; requiring consideration of the

11         costs of expansion and testing; requiring a

12         report; providing for termination of the task

13         force; providing an effective date.

15  Be It Enacted by the Legislature of the State of Florida:

16

17         Section 1.  (1)  There is created within the Division

18  of Children's Medical Services Prevention and Intervention of

19  the Department of Health the Infant Screening Programs Task

20  Force. This task force is created to perform comparative

21  research regarding the infant screening programs currently

22  operating in other states. The task force consists of 15

23  members as follows:

24         (a)  All members of the Genetics and Infant Screening

25  Advisory Council.

26         (b)  One member of the Florida Hospital Association

27  designated by the executive director of the association.

28         (c)  One member of the Florida Statutory Teaching

29  Hospital Council designated by the chair of the council.

30         (d)  One representative from the Florida chapter of the

31  March of Dimes appointed by the head of the Florida chapter.

  1         (2)(a)  The first meeting of the task force shall be

  2  held in Tallahassee no later than May 1, 2002.

  3         (b)  The chair of the Genetics and Infant Screening

  4  Advisory Council shall serve as the chair of the task force.

  5  All decisions of the task force shall be by majority vote of

  6  the members present at a duly convened meeting of the task

  7  force. All meetings and records of the task force are subject

  8  to the requirements of s. 24, Art. I of the State

  9  Constitution.

10         (c)  Members of the task force that are members of the

11  Genetics and Infant Screening Advisory Council shall receive

12  per diem as provided in s. 112.061, Florida Statutes; other

13  members of the task force shall pay their own expenses.

14         (3)  Staff of the Division of Children's Medical

15  Services Prevention and Intervention shall be assigned by the

16  director to provide support to the task force.

17         (4)  The task force shall collect data from all states

18  operating infant screening programs. All necessary research

19  shall be completed by no later than August 1, 2002.

20         (5)  Based upon the data collected, the task force

21  shall prepare recommendations regarding the newborn infant

22  screening requirement provided in s. 383.14, Florida Statutes,

23  and develop a newborn infant screening plan tailored to the

24  needs of Florida's population. As part of the review of

25  current screening requirements and in the formulation of its

26  recommended plan, the task force shall consider the cost of

27  current testing, the cost of expansion, appropriate mechanisms

28  for reimbursing the cost of testing, and the appropriate

29  location for such testing.

30         (6)  The task force shall submit a final report of its

31  review and recommended plan to the Secretary of Health, the

  1  Governor, the President of the Senate, and the Speaker of the

  2  House of Representatives no later than September 1, 2002.

  3         (7)  The task force shall terminate upon the submission

  4  of the final report.

  5         Section 2.  This act shall take effect upon becoming a

  6  law.
