  1                      A bill to be entitled

  2         An act relating to trust funds; terminating and

  3         re-creating the Juvenile Care and Maintenance

  4         Trust Fund within the Department of Juvenile

  5         Justice without modification; carrying forward

  6         current balances and continuing current sources

  7         and uses thereof; providing an effective date.

  8

  9         WHEREAS, the Legislature wishes to extend the life of

10  the Juvenile Care and Maintenance Trust Fund within the

11  Department of Juvenile Justice, which is otherwise scheduled

12  to be terminated pursuant to constitutional mandate, and

13         WHEREAS, the Legislature has reviewed the trust fund

14  before its scheduled termination date and has found that it

15  continues to meet an important public purpose, and

16         WHEREAS, the Legislature has found that existing public

17  policy concerning the trust fund sets adequate parameters for

18  its use, NOW, THEREFORE,

20  Be It Enacted by the Legislature of the State of Florida:

21

22         Section 1.  (1)  The Juvenile Care and Maintenance

23  Trust Fund within the Department of Juvenile Justice, which

24  has no FLAIR number and which is to be terminated pursuant to

25  Section 19(f), Article III of the State Constitution on July

26  1, 2006, unless terminated sooner by law, is terminated on

27  November 4, 2004, and re-created.

28         (2)  All current balances of the trust fund are carried

29  forward, and all current sources and uses of the trust fund

30  are continued.

  1         Section 2.  This act shall take effect November 4,

  2  2004.

  5                       LEGISLATIVE SUMMARY

      Terminates and re-creates the Juvenile Care and
  7    Maintenance Trust Fund within the Department of Juvenile
      Justice in order to synchronize its review cycle with
  8    other trust funds of the department.
