13         Amendment (with title amendment) 

14         On page 24, between lines 28 and 29,

15

16  insert:

17         Section 8.  Subsection (14) is added to section

18  403.708, Florida Statutes, to read:

19         403.708  Prohibition; penalty.--

20         (14)(a)  Discarded wood treated with chromated copper

21  arsenate shall not be disposed of in an unlined landfill or by

22  open burning, and shall not be used in the production of mulch

23  or compost, after July 1, 2003. However, this prohibition

24  shall not apply in those cases where the department determines

25  that it is impracticable to separate small amounts of wood

26  treated with chromated copper arsenate from the waste stream.

27  No later than January 1, 2003, the department shall initiate

28  rulemaking to establish criteria for implementing the

29  provisions of this paragraph.

30         (b)  The department shall conduct a study of the

31  expected impacts to public health and the environment from the

  1  controlled burning of wood treated with chromated copper

  2  arsenate, and of the management of ash from such burning. The

  3  department is authorized to adopt rules to address any such

  4  impacts, which rules may include a prohibition on burning wood

  5  treated with chromated copper arsenate.

10         On page 1, line 30, after the semicolon,

11

12  insert:

13         amending s. 403.708, F.S.; prohibiting certain

14         disposal or use of wood treated with chromated

15         copper arsenate after a specified date;

16         providing an exception; requiring a study of

17         certain impacts from the controlled burning of

18         such treated wood; providing rulemaking

19         authority;
