1 A bill to be entitled
2 An act relating to illegal smuggling of aliens;
3 providing a definition; providing a penalty for
4 smuggling, attempting to smuggle, or conspiring
5 to smuggle, aliens into the state; providing an
6 increased penalty when an alien is killed as a
7 result of a violation of the act; providing an
8 effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Illegal smuggling of aliens into state;
13 definition; penalties; increased penalty where death
14 results.--
15 (1) For the purposes of this section, "alien" means a
16 person who is neither a resident of nor a citizen of the
17 United States.
18 (2) It is unlawful for any person to knowingly
19 smuggle, attempt to smuggle, or conspire to smuggle any alien
20 into this state.
21 (3) Any person who violates the provisions of
22 subsection (2) commits a felony of the second degree,
23 punishable as provided in s. 775.082, Florida Statutes, s.
24 775.083, Florida Statutes, or s. 775.084, Florida Statutes.
25 (4) In the event that any alien is killed as a result
26 of an attempt to smuggle the alien into this state in
27 violation of subsection (2), the person contracting for or
28 attempting to smuggle the alien into the state commits a
29 felony of the first degree, punishable as provided in s.
30 775.082, s. 775.083, or s. 775.084, Florida Statutes.

1 Section 2. This act shall take effect upon becoming a
2 law.

Provides a second degree felony penalty for smuggling,
7 attempting to smuggle, or conspiring to smuggle an alien
into the state. Provides a first degree felony penalty
8 when an alien is killed in an attempt to illegally
smuggle the alien into the state.
