10 Department of Elderly Affairs and the Agency
11 for Health Care Administration; requiring a
12 report; providing for development of a
13 private-public partnership to develop and
14 operate a facility in an urban core area;
15 providing design principles; providing for
16 appointment of an advisory group to guide the
17 study and the private-public partnership
18 development effort; providing for the advisory
19 group's membership, meetings, and staff
20 support; providing for termination of the
21 advisory group; providing an appropriation;
22 providing an effective date.

24 Be It Enacted by the Legislature of the State of Florida:
25
26 Section 1. Legislative findings.--The Legislature
27 finds that many elderly persons face a multitude of chronic
28 health problems and need an integrated package of health,
29 personal care, and social services, which are often not
30 offered in any systematic way in their communities. The
31 Legislature finds that the model of long-term care support

1 known as "assisted living" is a residential care model that
2 combines rental apartment living with supportive services to
3 aid the frail elder in performing the activities of daily
4 living. The Legislature finds that assisted living offers
5 elders services that may include personal care, housekeeping,
6 linen service, medication management, and 24-hour oversight.
7 The Legislature also finds that purchasing assisted-living
8 services is often out of the reach of low-income and
9 moderate-income elders and that existing long-term care
10 services do not adequately meet the needs of these elders.
11 The Legislature finds that assisted living can be a
12 cost-effective option for meeting the needs of frail elders.
13 The Legislature finds that in addition to providing more
14 options for residents, expanding long-term care options has
15 positive economic impacts on communities, as initial
16 construction of new facilities and renovation of existing
17 buildings boost the local economy. The Legislature finds that
18 there are barriers to the development of affordable
19 assisted-living facilities to serve low-income and
20 moderate-income frail elders, particularly in urban,
21 African-American communities, and that technical expertise
22 from various groups and disciplines must be brought together
23 to overcome these barriers.
24 Section 2. Affordable assisted-living services for
25 minority persons.--
26 (1) STUDY; REPORT.--The Shimberg Center for Affordable
27 Housing at the University of Florida shall contract with the
28 Institute on Urban Policy and Commerce at Florida Agricultural
29 and Mechanical University to study the adequacy and
30 availability of affordable assisted-living services to
31 minority persons in at least one urban core community in each

1 of the following counties: Miami-Dade, Pinellas, Orange,
2 Hillsborough, Duval, and Leon. The Department of Elderly
3 Affairs and the Agency for Health Care Administration shall
4 provide access to such reports, records, and data as are
5 needed by the institute to complete the study. The institute
6 shall submit its report to the President of the Senate, the
7 Speaker of the House of Representatives, and the majority and
8 minority leaders in each chamber no later than December 22,
9 2003.
10 (2) DEVELOPMENT OF AN AFFORDABLE ASSISTED-LIVING
11 FACILITY; PUBLIC-PRIVATE PARTNERSHIP.--The Shimberg center,
12 the institute, the agency, and the department shall work
13 together with at least one community designated by the
14 institute pursuant to chapter 99-251, Laws of Florida, to
15 develop a public-private partnership to facilitate the
16 development and operation of an affordable assisted-living
17 facility in an urban core area. Those entities and the
18 public-private partnership shall include at least the
19 following principles in their design:
20 (a) Accessibility for visually, cognitively, or
21 mobility impaired residents as a basic requirement for a
22 functional environment.
23 (b) A stimulating environment that is safe but
24 challenging.
25 (c) Accommodation for changes in visual, auditory, and
26 olfactory senses in the environment and design.
27 (d) Use of historical reference and solutions
28 influenced by local tradition to provide a sense of the
29 familiar and to enhance the resident's sense of continuity.
30 (3) ADVISORY GROUP.--The director of the institute
31 shall appoint an advisory group to assist and guide the study

1 and the public-private partnership development effort. The
2 advisory group shall terminate upon the submission of the
3 report to the Legislature required under subsection (1).
4 (a) The advisory group shall include at least the
5 following members:
6 1. A staff person of the Agency for Health Care
7 Administration, appointed by the Secretary of Health Care
8 Administration.
9 2. The Secretary of Health or the secretary's
10 designee.
11 3. The Secretary of Elderly Affairs or the secretary's
12 designee.
13 4. One member affiliated with the Office of Tourism,
14 Trade, and Economic Development.
15 5. The President of Enterprise Florida, Inc., or the
16 president's designee.
17 6. One member affiliated with Workforce Florida, Inc.
18 7. One member from the Florida State University
19 College of Medicine, appointed by the Dean of the College of
20 Medicine.
21 8. One member from a private-sector investment
22 institution or organization.
23 9. One member from a professional trade organization
24 representing assisted-living facilities.
25 10. The Director of the Real Choice Partnership
26 Project in the office of the Americans with Disabilities
27 Working Group.
28 (b) The advisory group shall be appointed by September
29 1, 2002, and shall have its first meeting no later than
30 October 1, 2002. The advisory group shall meet at least three

1 times before submitting the report required under subsection
2 (1).
3 (c) The institute shall provide staff support for the
4 advisory group and may reimburse travel expenses for such
5 staff in accordance with s. 112.061, Florida Statutes.
6 Section 3. There is appropriated from the Housing
7 Finance Corporation Trust Fund to the Institute on Urban
8 Policy and Commerce at Florida Agricultural and Mechanical
9 University the sum of $150,000 to fund the study on affordable
10 assisted-living services for minority persons provided for in
11 this act.
12 Section 4. This act shall take effect July 1, 2002.
