17 Section 1. Section 381.0421, Florida Statutes, is
18 created to read:
19 381.0421 Vaccination against meningococcal meningitis
20 and hepatitis B.--
21 (1) A postsecondary educational institution shall
22 provide detailed information concerning the risks associated
23 with meningococcal meningitis and hepatitis B and the
24 availability, effectiveness, and known contraindications of
25 any required or recommended vaccine to every student, or to
26 the student's parent or guardian if the student is a minor,
27 who has been accepted for admission.
28 (2) An individual enrolled in a postsecondary
29 educational institution who will be residing in on-campus
30 housing shall provide documentation of vaccinations against
31 meningococcal meningitis and hepatitis B unless the

1 individual, if the individual is 18 years of age or older, or
2 the individual's parent or guardian, if the individual is a
3 minor, declines the vaccinations by signing a separate waiver
4 for each of these vaccines, provided by the institution,
5 acknowledging receipt and review of the information provided.
6 (3) This section does not require any postsecondary
7 educational institution to provide or pay for vaccinations
8 against meningococcal meningitis or hepatitis B.

12 And the title is amended as follows:
13 On page 1, lines 6-30, and on page 2, lines 1-12 ,
14 remove: all of said lines

16 and insert:
17 meningococcal meningitis and hepatitis B
18 vaccines and, if residing in on-campus housing,
19 provide documentation of vaccination against
20 meningococcal meningitis and hepatitis B, or a
21 statement declining such vaccination; providing
22 an effective date.

24 WHEREAS, meningococcal meningitis is a serious disease
25 that can lead to death within a few hours of onset, and
26 WHEREAS, meningococcal meningitis is a highly
27 contagious but largely preventable infection of the
28 spinal-cord fluid and the fluid that surrounds the brain, and
29 WHEREAS, one in ten cases of meningococcal meningitis
30 is fatal, and
31 WHEREAS, one in seven survivors is left with a severe

1 handicap, such as loss of a limb, mental retardation,
2 paralysis, deafness, or seizures, and
3 WHEREAS, individuals of any age can carry the disease
4 for days, weeks, or months unknowingly or without becoming
5 ill, and
6 WHEREAS, at any time, from 10 to 25 percent of the
7 population carries meningococcal meningitis, and
8 WHEREAS, scientific evidence suggests that college
9 students living in dormitory facilities are six times more
10 likely than other individuals to contract meningococcal
11 meningitis, and
12 WHEREAS, immunization against meningococcal meningitis
13 will decrease the risk of disease, and
14 WHEREAS, the Centers for Disease Control and Prevention
15 recommends that college students be vaccinated against this
16 disease, and
17 WHEREAS, the Legislature urges that college freshmen
18 residing in on-campus housing be vaccinated against
19 meningococcal meningitis, NOW, THEREFORE,
