11  The Committee on Health Regulation offered the following:

13         Amendment (with title amendment)

17         Section 1.  Section 381.0421, Florida Statutes, is

18  created to read:

19         381.0421  Vaccination against meningococcal

20  meningitis.--

21         (1)  A postsecondary educational institution shall

22  provide detailed information on the risks associated with

23  meningococcal meningitis and the availability, effectiveness

24  and known contraindications of any required or recommended

25  vaccine to all students, or their parent or guardian if the

26  student is a minor, who have been accepted for admission.

27         (2)  An individual enrolled in a postsecondary

28  educational institution who will be residing in on-campus

29  housing shall provide documentation of vaccination against

30  meningococcal meningitis, or an individual, if the individual

31  is 18 years of age or older, or an individual's parent or

  1  guardian, if the individual is a minor, may sign a waiver

  2  provided by the institution stating that they have received

  3  and reviewed the information provided and has chosen not to be

  4  vaccinated against meningococcal meningitis.

  5         (3)  Nothing in this section shall be construed to

  6  require any postsecondary educational institution to provide

  7  or pay for vaccinations against meningococcal meningitis.

  8         Section 2.  This act shall take effect July 1, 2002.

17         An act relating to immunizations; creating s.

18         381.0421, F;S.; requiring individuals enrolled

19         in a postsecondary educational institution be

20         provided information regarding meningococcal

21         meningitis vaccine; and if residing in

22         on-campus housing provide documentation of

23         vaccination against meningococcal meningitis or

24         sign a waiver stating they have received and

25         reviewed information about the vaccination but

26         have not been vaccinated; providing an

27         effective date.

29         WHEREAS, meningococcal meningitis is a serious disease

30  that can lead to death within only a few hours of onset, and

31         WHEREAS, meningococcal meningitis is a highly

  1  contagious but largely preventable infection of the spinal

  2  cord fluid and the fluid that surrounds the brain, and

  3         WHEREAS, one in 10 cases of meningococcal meningitis is

  4  fatal, and

  5         WHEREAS, one in seven survivors is left with a severe

  6  handicap, such as loss of a limb, mental retardation,

  7  paralysis, deafness, or seizures, and

  8         WHEREAS, individuals of any age can carry the disease

  9  for days, weeks, or months unknowingly or without becoming

10  ill, and

11         WHEREAS, at any time, from 10 to 25 percent of the

12  population carries meningococcal meningitis, and

13         WHEREAS, scientific evidence suggests that college

14  students living in dormitory facilities are six times more

15  likely than other individuals to contract meningococcal

16  meningitis, and

17         WHEREAS, immunization against meningococcal meningitis

18  will decrease the risk of disease, and

19         WHEREAS, the Legislature recommends that college

20  freshmen residing in on-campus housing should be vaccinated

21  against meningococcal meningitis, NOW, THEREFORE,
