  2         An act relating to enterprise zones; amending

  3         s. 290.0065, F.S.; authorizing certain counties

  4         to apply to the Office of Tourism, Trade, and

  5         Economic Development to amend the boundaries of

  6         certain enterprise zones or communities for

  7         certain purposes; providing an effective date.

  8

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  Subsection (9) of section 290.0065, Florida

12  Statutes, is amended to read:

13         290.0065  State designation of enterprise zones.--

14         (9)(a)  Before December 31, 2002 1998, the governing

15  body of a county in which an enterprise zone designated

16  pursuant to paragraph (5)(b) is located may apply to the

17  Office of Tourism, Trade, and Economic Development to amend

18  the boundaries of the enterprise zone for the purpose of

19  replacing areas not suitable for development.

20         (b)  Before December 31, 2002, the governing body of a

21  county in which an enterprise zone designated pursuant to

22  subparagraph (3)(a)2. is located may apply to the Office of

23  Tourism, Trade, and Economic Development to amend the

24  boundaries of the enterprise zone for the purpose of replacing

25  areas not suitable for development.

27  The Office of Tourism, Trade, and Economic Development shall

28  approve the application if it does not increase the overall

29  size of the enterprise zone.  Except that upon the request of

30  the governing body of a home rule charter county, or any

31  county the government of which has been consolidated with the

  1  government of one or more municipalities in accordance with s.

  2  9, Art. VIII of the State Constitution of 1885, as preserved

  3  by s. 6(e), Art. VIII of the State Constitution as revised in

  4  1968 and subsequently amended, the Office of Tourism, Trade,

  5  and Economic Development may amend the boundaries of an area

  6  designated as an enterprise zone upon the receipt of a

  7  resolution adopted by such governing body describing the

  8  amended boundaries, so long as the added area does not

  9  increase the overall size of the expanded zone more than its

10  original size or 20 square miles, whichever is larger, and is

11  consistent with the categories, criteria, and limitations

12  imposed by s. 290.0055.

13         Section 2.  This act shall take effect upon becoming a

14  law.
