1 A bill to be entitled
2 An act relating to trust funds; re-creating the
3 Security Deposits Trust Fund within the
4 Department of Highway Safety and Motor Vehicles
5 without modification; carrying forward current
6 balances and continuing current sources and
7 uses thereof; providing an effective date.

9 WHEREAS, the Legislature wishes to extend the life of
10 the Security Deposits Trust Fund within the Department of
11 Highway Safety and Motor Vehicles, which was declared to be
12 exempt from the automatic termination provisions of the State
13 Constitution by section 1(2)(d) of chapter 94-41, Laws of
14 Florida, but which after Legislature review has been found not
15 to be exempt from such provisions, and
16 WHEREAS, the Legislature has found that the trust fund
17 continues to meet an important public purpose, and
18 WHEREAS, the Legislature has found that existing public
19 policy concerning the trust fund sets adequate parameters for
20 its use and that the trust fund should be re-created, NOW,
21 THEREFORE,

23 Be It Enacted by the Legislature of the State of Florida:

25 Section 1. (1) The Security Deposits Trust Fund
26 within the Department of Highway Safety and Motor Vehicles,
27 FLAIR number 76-2-625, which was declared to be exempt from
28 the automatic termination provisions of the State Constitution
29 by section 1(2)(d) of chapter 94-41, Laws of Florida, is not
30 exempt from such automatic-termination and is re-created.

1 (2) All current balances of the trust fund are carried
2 forward, and all current sources and uses of the trust fund
3 are continued.
4 Section 2. This act shall take effect July 1, 2002.
