2 An act relating to professions; amending s.
3 455.271, F.S.; providing general authority for
4 the reinstatement of licenses that have become
5 void; amending s. 473.313, F.S.; providing for
6 the reinstatement of certain public accountancy
7 licenses that have become void; amending s.
8 489.116, F.S.; providing for the reinstatement
9 of certain contracting licenses that have
10 become void; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Subsection (6) of section 455.271, Florida
15 Statutes, is amended to read:
16 455.271 Inactive and delinquent status.--
17 (6)(a) A delinquent status licensee must affirmatively
18 apply with a complete application, as defined by rule of the
19 board, or the department when there is no board, for active or
20 inactive status during the licensure cycle in which a licensee
21 becomes delinquent. Failure by a delinquent status licensee to
22 become active or inactive before the expiration of the current
23 licensure cycle shall render the license void null without any
24 further action by the board or the department. Any subsequent
25 licensure shall be as a result of applying for and meeting all
26 requirements imposed on an applicant for new licensure.
27 (b) However, the board or the department, if there is
28 no board, may, at its discretion, reinstate the license of an
29 individual whose license has become void if the individual has
30 made a good-faith effort to comply with this section but has
31 failed to comply because of illness or unusual hardship. The

1 individual must apply to the board or the department, if there
2 is no board, for reinstatement in a manner prescribed by rules
3 of the board or the department, if there is no board, and
4 shall pay an application fee in an amount determined by rule.
5 The board or the department, if there is no board, shall
6 require that such individual meet all continuing education
7 requirements prescribed by law, pay appropriate licensing
8 fees, and otherwise be eligible for renewal of licensure under
9 this chapter.
10 Section 2. Subsection (4) of section 473.313, Florida
11 Statutes, is amended to read:
12 473.313 Inactive status.--
13 (4) Notwithstanding the provisions of s. 455.271, The
14 board may, at its discretion, reinstate the license of an
15 individual whose license has become null and void if the
16 individual has made a good-faith good faith effort to comply
17 with this section but has failed to comply because of illness
18 or unusual hardship. The individual must shall apply to the
19 board for reinstatement in a manner prescribed by rules of the
20 board and shall pay an application fee in an amount determined
21 by rule of the board. The board shall require that such an
22 individual meet all continuing education requirements as
23 provided in s. 473.312, pay appropriate licensing fees, and
24 otherwise be eligible for renewal of licensure under this
25 chapter.
26 Section 3. Present subsections (6), (7), and (8) of
27 section 489.116, Florida Statutes, are redesignated as
28 subsections (7), (8), and (9), respectively, and a new
29 subsection (6) is added to that section, to read:
30 489.116 Inactive and delinquent status; renewal and
31 cancellation notices.--

1 (6) Notwithstanding subsections (4) and (5), the board
2 may, at its discretion, reinstate the license of an individual
3 whose license has become void if the individual has made a
4 good-faith effort to comply with this section but has failed
5 to comply because of illness or unusual hardship. The
6 individual shall apply to the board for reinstatement in a
7 manner prescribed by rules of the board and shall pay an
8 application fee in an amount determined by rule of the board.
9 The board shall require that such individual meet all
10 continuing education requirements as provided in s. 489.115,
11 pay appropriate licensing fees, and otherwise be eligible for
12 renewal of licensure under this chapter.
13 Section 4. This act shall take effect July 1, 2002.
