  1                      A bill to be entitled

  2         An act relating to trust funds; creating s.

  3         216.273, F.S.; creating the Administered Funds

  4         Trust Fund within the Executive Office of the

  5         Governor; providing for sources and purposes;

  6         providing for exemption from constitutional

  7         termination; providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Section 216.273, Florida Statutes, is

12  created to read:

13         216.273  Administered Funds Trust Fund.--

14         (1)  The Administered Funds Trust Fund is created

15  within the Executive Office of the Governor.

16         (2)  The trust fund shall be used for the purpose of

17  allocating to various agencies those appropriations that are

18  made under the administered funds budget entity. The trust

19  fund is a clearing account to be used solely for the

20  distribution of budget authority and is not intended to

21  receive or distribute cash.

22         (3)  Pursuant to the provisions of s. 19(f)(3), Art.

23  III of the State Constitution, the trust fund, as a clearing

24  account is exempt from the automatic termination provisions of

25  s. 19(f)(2), Art. III of the State Constitution.

26         Section 2.  This act shall take effect July 1, 2002.
