  1                      A bill to be entitled

  2         An act relating to commodity procurement;

  3         amending s. 287.012, F.S.; redefining the term

  4         "commodity" to include certain accounting

  5         services; providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Subsection (4) of section 287.012, Florida

10  Statutes, is amended to read:

11         287.012  Definitions.--The following definitions shall

12  apply in this part:

13         (4)  "Commodity" means any of the various supplies,

14  materials, goods, merchandise, food, equipment, and other

15  personal property, including a mobile home, trailer, or other

16  portable structure with floor space of less than 3,000 square

17  feet, purchased, leased, or otherwise contracted for by the

18  state and its agencies.  For the purpose of replacing the

19  state accounting and cash management systems, the term

20  "commodity" includes accounting software and implementation

21  and project management services. "Commodity" also includes

22  interest on deferred-payment commodity contracts approved

23  pursuant to s. 287.063 entered into by an agency for the

24  purchase of other commodities. However, commodities purchased

25  for resale are excluded from this definition. Further, a

26  prescribed drug, medical supply, or device required by a

27  licensed health care provider as a part of providing health

28  services involving examination, diagnosis, treatment,

29  prevention, medical consultation, or administration for

30  clients at the time the service is provided is not considered

31  to be a "commodity." Printing of publications shall be

  1  considered a commodity when let upon contract pursuant to s.

  2  283.33, whether purchased for resale or not.

  3         Section 2.  This act shall take effect upon becoming a

  4  law.
