1 A bill to be entitled
2 An act relating to state uniform traffic
3 control; amending s. 316.121, F.S.; clarifying
4 provisions governing vehicles approaching or
5 entering intersections; providing an effective
6 date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Section 316.121, Florida Statutes, is
11 amended to read:
12 316.121 Vehicles approaching or entering
13 intersections.--
14 (1) The driver of a vehicle approaching an
15 intersection shall yield the right-of-way to a vehicle which
16 has entered the intersection from a different highway.
17 (2) When two vehicles enter an intersection from
18 different highways at the same time the driver of the vehicle
19 on the left shall yield the right-of-way to the vehicle on the
20 right.
21 (3) The driver of a vehicle about to enter or cross a
22 state-maintained road or highway from a paved or unpaved road
23 and not subject to control by an official traffic control
24 device shall yield the right-of-way to all vehicles
25 approaching on the state-maintained road or highway.
26 (4) The driver of a vehicle about to enter or cross a
27 paved county-maintained road or highway from a paved or
28 unpaved road that is not maintained by a governmental entity
29 and not subject to control by an official traffic control
30 device shall yield the right-of-way to all vehicles
31 approaching on the county-maintained road or highway.

1 (5)(4) The driver of a vehicle about to enter or cross
2 a paved county-maintained or city-maintained road or highway
3 from an unpaved road or highway and not subject to control by
4 an official traffic control device shall yield the
5 right-of-way to all vehicles approaching on said paved road or
6 highway.
7 (6)(5) The foregoing rules are modified at through
8 highways and otherwise, as hereinafter stated.
9 (7)(6) A violation of this section is a noncriminal
10 traffic infraction, punishable as a moving violation as
11 provided in chapter 318.
12 Section 2. This act shall take effect July 1, 2002.
