17  and insert:  considered late, unless, in the opinion of the

18  division and/or the board, exceptional circumstances beyond an

19  employer's control prevented remittance by the prescribed due

20  date notwithstanding such employer's good faith efforts to

21  effect delivery. Such a waiver of delinquency by the division

22  and/or board may be granted an employer only one time each

23  fiscal year. The employer shall be assessed a penalty of 1
