18 Section 1. Study Commission on Citizen Legislative
19 Initiatives; purpose; membership; duties; expiration.--
20 (1) There is created within the Department of State
21 the Study Commission on Citizen Legislative Initiatives for
22 the purpose of making findings and recommendations regarding
23 the merits and feasibility of amending the State Constitution
24 to authorize legislation to be proposed by citizen initiative.
25 (2)(a) The commission shall consist of 11 members, 5
26 of whom the Governor shall appoint, 3 of whom the President of
27 the Senate shall appoint, and 3 of whom the Speaker of the
28 House of Representatives shall appoint.
29 (b) The Governor, the President of the Senate, and the
30 Speaker of the House of Representatives shall make
31 appointments to the commission before July 15, 2002.

1 (c) At least 8 of the commission members must be
2 citizen representatives of the private sector, including at
3 least two members who have specific expertise in state
4 constitutional issues. To the extent practicable, the
5 membership of the commission shall reflect the geographic
6 diversity of the state.
7 (d) Members of the commission shall serve without
8 compensation but shall be entitled to receive per diem and
9 travel expenses in accordance with section 112.061, Florida
10 Statutes, while in the performance of their duties.
11 (3) The commission shall hold at least four public
12 hearings for the purpose of receiving testimony from expert
13 witnesses, as well as testimony from the general public.
14 (4)(a) Before February 1, 2003, the commission shall
15 submit a report on its findings and recommendations to the
16 Governor, the President of the Senate, and the Speaker of the
17 House of Representatives.
18 (b) The report must include a recommendation on
19 whether the Legislature should adopt a joint resolution
20 proposing an amendment to the State Constitution authorizing
21 the proposal of legislation by initiative.
22 (c) The report, at a minimum, also must include:
23 1. Findings on the extent to which an amendment to the
24 State Constitution authorizing the proposal of legislation by
25 initiative is necessary;
26 2. Factors the Legislature should consider in
27 evaluating whether to adopt such a joint resolution;
28 3. Findings on the experiences of other states
29 relating to citizen legislative initiatives;
30 4. Recommendations on any limitations or conditions
31 that should be imposed on the proposal of legislation by

1 initiative or on laws enacted by initiative;
2 5. Recommendations on procedures the Legislature
3 should enact governing the proposal of legislation by
4 initiative if such a constitutional amendment were adopted;
5 6. Recommendations on whether there should be any
6 changes to the requirements or procedures relating to
7 amendments or revisions to the State Constitution that are
8 proposed by initiative petition.
9 (5) The Department of State shall provide staff and
10 other administrative support for the commission within
11 existing resources.
12 (6) This section expires July 1, 2003.
13 Section 2. This act shall take effect upon becoming a
14 law.
